Mail it in the same envelope as AOS to Chicago. Or do I have to send mine to Laguna? Do I send a seperate check? I knew the case register would ring again. Hell, I'm filing for AOS and she has a SS card. Now they want to squeeze more out. Would my catagory be (a)(6), ©(9)? both? A friend of mine who has already filed his AOS wanted me to ask this question: If the green card and social security number is issued, why can't the recipient legally go to work? IF you are K-1, (a )(6 ) is BAD, it will cause an EAD card to be issued that expires the same time as the K-1's I-94, (90 days from entry) it can take up to 90 days to get a useless card. If you entered on K-1 file for EAD at the same time as you file for AOS, under category (c )(9 ). Most employers use an SS# as an identifier and we all know the SS# is used to deduct taxes from our paycheck. The concern for EAD has been the length of time it takes to receive the green card. In some cases I've heard of and seen, it takes just as long to get an EAD as it does the green card and the argument could be it's a waste of time and money Ron. Be well my friend! Link to comment

For K-3 it is prefered to file for EAD before AOS, the EAD issued will have its expirarion set to that of the I-94 card, which for K-3 tends to be 2 years from the date of entry. For K-1 it is prefered to file for EAD with or after filing for AOS, because the EAD will be a 1 year EAD, if a K-1 files for it before AOS the EAD will expire the same time as the K-1 I-94 (90 days after entry) Code (a )(x ) results in EAD expiring same time as the I-94 and is filed before AOS. Code (c )(9 ) results in a 1 year EAD and is filed at the same time or after filing AOS. The wait for the green card can be anywhere from 3 months to 2 years and longer after applying for AOS. The wait for employment authorization is 2 to 3 months. EAD, of course, is optional and serves to fill the gap (if there is one) until the green card arrives. Link to comment
