Our current and 3rd blue slip

The now want the credit card statements showing I bought the tickets. ok fine I have them. They had the bank receipts showing this but................

 

They are saying I do no make enough money to file for her and lulu. Even with my assetts I have. It is not enough. Which it is. Just the equity in the house alone is good enough.

 

They say I need a co-sponsor. Well that is the story. \

 

No-one in my family will sign. So we are going to be SOL here. I will try and resubmit my I-134 about myself again and see. But no co-signers for us in my family I am sure.

 

Even if we get married, she will not get a visa for the same reason. I live on SSDisability.

 

 

 

Someone can tell me what is involved in staying in China to live? If so Pm me with the details.

 

If you decide to move to China, disability has to continue to send you monthly checks in China. Your money would go a lot further there.

 

Assuming your SSD checks are direct deposit, you could just use your debit card to obtain cash in China. You could also deposit you proceeds from eventual sale of your home and access that money from China the same way.

 

People who have looked more into retirement in China can provide some more details for you but from a high level, you would need either and "employer" in China for a long term visa or every few months you would need to leave China and return again using a new visa. This isn't a huge deal. I think it's a two or three hour train ride to Viet Nam. Your prescription medicine could probably be relayed by mail or simply obtained in China. Any medical care would be out of pocket but it is not nearly as expensive there as it is here. For China, you have a good income.

 

I'd give it a shot by answering the blue slip. She can probably do it by mail without showing up in GUZ. As somebody else said, there are guidelines. Technically you meet them but the VO must still be satisfied that your wife and daughter will not become a public charge. As a practical matter, you will always need housing, so converting the equity in your home is a temporary solution to a permanent problem.

 

I agree that the low income from disability along with your recent divorce is likely what sparked the fraud suspicion. Now they want more current financials and have suggested a co-sponsor. You'll just have to do the best you can or bag it and move to China.

 

It might be helpful to provide the exact words on the blue slip instead of your interpretation. Perhaps there's a further clue there to additional eyes.

 

 

 

I did not interprete anything, I said exactly what the green slip says. Need a cosponsor. The blue slip says they want my *credit card statements*, not bank statments, for the plane tickets. Nothing else about anything anywhere on the papers.

 

Lee, I am using the numbers that I filed under last year. As long as the application is active for that year I filed in, I can use those numbers for myself. Now a new sponsor will use the 2006 current, until April of 2007 when the new numbers come out.

 

Lee, anyway you look at it, this is a mess.

I don't want to detract from the topic but ... Doesn't being married to a citizen of the PRC allow one to have a long term or better visa in the PRC?

 

 

Yes, you can obtain a one year multiple entry visa good for a year. I think each stay can be 60 days but that can be routinely extended at the local police station for perhaps as long as 120 days or more. Once they tell you they won't extend it again, you must leave and re-enter China. The workaround is for somebody to list you as an official employee and obtain a work visa. Not everybody has the connections to do this.

 

Rick, I was suggesting you provide the complete sentences from any directly relevant portion of the blue slip, in case they could possibly be interpreted differently. I doubt they can but its worth a shot.

IMHO it seems like someone is determined to continue to justify the original blue slip so they peeled back on the I134 with more detail. If you do meet the requirements then resubmit that along with the proof that you paid for your own trips there.

Yes having a spouse in China will give you long term residence in China. Yes Rick resubmit the I-134 showing that you indeed have the assets and the proof they asked for about the trips. If this isn't enough for them then nothing will be. Only then can you give up being able to bring them to the USA. If this is the case then going to China won't be all that bad. I doubt you will get jerked around there like you have here. You can indeed live a lot better there on your disability than in the US by far! Might want to check into whether the US can revoke your disability if you indeed do move to China.

My wife told me that in her city of Jiujiang the police would extend it for as long as I wanted. And of course one can always apply for a chinese green card.

Because it is a legitimate concern until you reach the SS retirement age, I would maintain the same bank account for direct deposit and a US mailing address (it could be friend or family's address) and just not tell them anything.

 

My understanding is that to qualify for SSD, the disability must be considered permanent. Unless yours is different, I doubt you have anything to worry about at all.

Duke, mine is permanent. I do access my money straight from the bank anyway. Direct deposit, Here, and I get it in China.

Damn if you aren't right!! But given the recent statements from my family and friends, DROP HER. I doubt anyone will sign the I-134 for us.

Let's keep in mind that the required form is an I-134. Let's not confuse it with references to I-864 which is a whole different animal. I-134 is considered non-enforcible.

Then why is it they are asking for a I-134 cosponser?

 

 

I think Don is talking about enforceability, not requirements.

Given the fact that the vast majority of married couples here in the US have a 2 income family, I don't see why this would not be any different for Rick and Yanlan if they could just be given the chance. Our immigration policies are just too strict and don't allow for all possibilities. Certainly Yanlan should be given the chance to find a job here in the US. Our government always assumes the worst case senario and does not give people a chance.

That's one thing you don't want to do, Rick. I know you are not planning that. It is so obvious that you love Yanlan and she loves you very much. I know you will work through this and I hope you can come up with a co sponsor. My best wishes as always. Ron :lol:

Time to put your pride aside and REALLY look for sponsor. I am sure one of your family or friends will sign . Someone out there must have a big heart. I would go and talk FACE TO FACE with each one of my family and friends and ask (Even neighbors). I am sure someone will sign. Go for it NOW!

 

At least you'll know you tried your best and, I think you'll be surprised at the results...
