I-130 or I 129F ??

Hi,

I read some peoples timeline and some of you filed a I130 and some other a I 129.

What is the difference?

is I129F for K1 and K2 and I130 for K3 and K4 ?

Yes.

 

For a Fiance(e): the I129F is filed for K1/K2

 

For a Spouse: the I130 is filed. Once the NOA1 is received the USC can optionally file an I129F for a K3/K4. Historically the K3/K4 took longer than the processing of the I130. As of the past 6 months that has not been the case.

In the I130 do you include the child or just in the I129F ?

 

 

Basicaly you do I130 and since it takes so long you do the I129F to have them come here.

 

And if one goes faster, no big deal, it's a visa anyway.

You almost have it. At some point in time, somebody has to file an I-130 for the child too. I think it is best to file them both at the same time so they are completed somewhere near the same time. There is always the chance things will turn around and the CR1/I-130 will get through faster. In that case you have a visa for the mother but not the child.

 

The child has derivitive status on the K1/K3 (I-129F) but not on the CR1/I-130.

Good point. Each I-130 is currently $190 and the I129F $170. David, do we have in one place a list of all the fees through each step of the process? I know how to look up the fees for individual forms but I don't know how to find out all the line items of fees associated with any specific visa process.

 

A new thread is probably in order for the answer to this. For instance, assuming my I-130's are eventually abandoned, what other K3/K4 related fees are applicable as the process progresses both before and after arrival in the USA? At which points in the process are payments due? Is the answer different for K1/K2 than for K3/K4?

Here is my wife's timeline. I filed both the I-129 & I-130. The I-129 made it to the consulate first but she interviewed as a CR-1, which I feel, is an advantage. She has received her Social Security Card & Green Card already. This weekend she will get her DMV ID Card.

In a nutshell if you are married you must file the I-130. This is the basis for all other petitions you might file in conjunction with the I-130. The

1-130 alone will grant you a CR-1 or CR-2 visa. The trend over the last few years is K-visas are faster. If you file an I-130 you may then file an I-129 F for a K-3 / K-4 visa. If the K-3 is approved first your wife may then come to the US to await the approval of the I-130. Once the

I-130 is approved you will then have the options of either adjusting status on the K-3 or wait for an interview date in GZ and fly back to China for the interview. In both cases if you have been married for less than 2 years at the time of interview you will receive a conditional green card. If married for more than 2 years you will receive the 10 year unconditional green card.
