I and my son came to USA on the K3/4 visa 5 months ago,and it took us a lot of time to settle down and get used to it. It has been great experience. Since it is just few months far from our second anniversary,so we decided to wait a little bit to file for the I-485,AOS. And in the mean time our I-130 is going through the process pretty smooth,last month we recieved the notice from NVC that out cases have been completed and forwarded to GUZ,which means we are now at the last step waiting for the CR1 interview date,P4,and it also means in this case we will have to fly back to China for the interview. I do not know how long it will take to finally get the P4,and we were wondering if we should also file I-485 in the meantime,which means another $800 something.To wait or to file? which one is better? According to what I heard and what I read,if at this time we file for the I-845,it would mess up the process of my I-130,and it would take longer for us to get the green card,it is true? Is it unsual that people who are already in USA flying back to get the interview done? Some people out there have done this before or have good suggestions,please help!!! warpedbored Posted January 8, 2006 Report Share Posted January 8, 2006 (edited) If you file AOS here in the states and you have been married 2 years at the time of the AOS interview you will receive the 10 green card. Since your I-130 is at GZ now it would probably be faster to fly to GZ for the interview. If money is the consideration it would be cheaper to file AOS here than buy 2 tickets to China. david_dawei Posted January 8, 2006 Report Share Posted January 8, 2006 My guess is that most K3s file the AOS here in the states and take the lesser of two costs, rather than fly back to China. (Maybe it's the feeling "we're here to stay" and wanting to just settle down and not deal with going back.) As Carl states, if it's about the money... file AOS here. If you can put the money consideration aside, I personally think going back is the better choice for some reasons already given.. the only addition I would mention is that of 'work'. You cannot work until you get an EAD or greencard. To go to the CR1 interview means a greencard and therefore the ability to work... but I know that at this point, you are actually waiting for P3, so some time needs to pass first. If you file AOS here, you can either wait out the greencard to work, or file for EAD at same time (additional $180) to be able to work. It would be good to hear two items from you?- Where you live... someone might be able to share the time AOS process is taking for that area- The age of your son... would clarify the cost of AOS for your son and some might possibly make advice/comments specific to him... I think this is just a waiting game,but unfortunately we have waited for too long to deal with it any more. It took about one year and four months to get the k3/4 done,and for the I-130 it is nearly 2 years,and I wonder if I choose to file AOS now,this game will take us another year or more to get it done somewhere. This Jan 20th will be our second annivesary,so I guess if I go for the CR1 interview,I would get the permernent green card,so this way we will be off this game for a while. And I want to say it is both about time and money issue,though I got a one year work permit and also my SSN few days before X-mas.I guess mostly we just want it to be done asap,to get this pain off our back! So if we would get the P4 in a short time,I guess we will choose to fly back option,and then hopefully life will be a lot easier after that.(Then we even do not have to think to remove the condition) Oh,by the way,my son is just 10 years old,and we live in TACOMA,40 mins drive from Seattle,nice place,but always raining now,just like my home town Chengdu,oh,God,I miss food there!!! But thinking about interview back there,it always makes me tense and nervous,as I was interviewed by the black pearl last time for about half an hour and over 20 questions one after another,gosh!!! I do not want to say that she is rude or cold,she should just be doing her job,strictly.But I just wish she could smile a little once in a while to make it easier on both side.Smile is like sunshine,and everybody needs it. So right now I am thinking if it would be as diffifult as last time???Pray for me,as I do for all of you!!!Thanks again ! Any other advices is always welcome! Link to comment
