AOS Letter - I-797 letter for Adj. of status

Hi, My wife finally got her Notice of Action letter for her I-485 Adjustment of Status. The original I-485 had a receipt date of

October 7th, 2004. This notice is dated Nov. 21, 2005.

 

It is the "welcome to the USA letter" that notifies my wife she will

soon get a green card in the mail. In the middle, it said that it will

expire in 10 years. Does this mean that she does not need to

remove conditions? She had her AOS interview just prior to

our 2 year wedding anniversary. We married in China and she

came over on an I-130/I-129 about a year after we married.

Congratulations to you and your wife, Randy!

There are no conditions to be removed with the 10-year alien registration card (greencard).

The next step would be naturalization in 3 years should your wife want to pursue citizenship.

There's an informative manual on the USCIS website about citizenship, and it is in Chinese.

By the way, where did the "welcome letter" come from? Local office or service center?

Congrats - it looks like the undconditional 10 year green card!

 

Of course, give your circumstances, I'm sure you'll want to wait until you get the actual card in the mail to be confidant, but if that's what the I-797 reads, you should be good to go.

 

It's possible that although 2 years since your marriage hadn't happened at the time of the AOS interview, you were so close that they let it slide. I have friends who were a month short on AOS after a K1 and they got stuck with the 2 year conditional one, however.

 

It also might be that although the AOS interview didn't happen prior to 2 years, the processing wasn't complete until after the 2 years? Just speculation on my part ...

 

Anyway - congrats - great Christmas present for you!
