  1. I believe the US law for K2 applicants for green card changed in 2012. This change in law enabled K2 applicants who entered the US before their 21st birthday, but who turned 21 before adjusting status to get their green card. The law held that the K2 applicant's age was considered "frozen" as of the date of entry to the US. I'm trying to find specific law regarding this issue from a government website or posting. Anyone here familiar with it?
  2. K1 case filed in December, 2013. Case approved early May, 2014. Case arrived GZ, May 2014. No P3 ever issued. GZ repeatedly states they returned case to USCIS. Explanation. None. Directed to contact USCIS for explanation. Dozens of written and telephone contacts to USCIS state: "We don't have the case. Case is at the consulate. Contact them." Repeated contacts to NVC produce same result. Repeated contacts to the consulate achieve increasingly belligerent replies that include, "Do not contact us anymore. Your case was returned to USCIS, contact them. Today, more than 491 days have elapsed since filing for K1. No interview was ever provided. No explanation was ever provided. Two senators and two members of congress have been unable to learn what happened to the case or why. Case still appears on the NVC website as: Note, that daughter's number rolled off after her 21st birthday in 2014. Torture of American citizens at the hands of American immigration is permitted.
  3. My new girlfriend has a one year "M" B-2 visa and has already been to my lovely city already. We contacted a lawyer and he said doing a CR-1 here is not too much of an issue? She has a 14 year old son, and what is quicker to bring him here my thinking is K-1? The other issue is she was CCP when she taught at a university, is that better handled in the USA or in China?
  4. Damn, it's been over 8-years since I did this am think I've forgotten more than I remember. So, let me post of couple of questions to hopefully gain some clarity: 1. I'm pretty clear about the K1 part of the visa paperwork, but have forgotten about how to add the K2 (child) to the initial paperwork? 2. Is K2 birth certificate or other documents required with the initial filing of the I-129F? 3. I know many states provide a certified one-page divorce certificate, which I provided on my previous filing. However, is it okay to send a copy of the final divorce decree? Are original copies needed, or will a photocopy suffice?
  5. I've talked to RandyW a little about filing for fiance visa while living in China. My fiance's daughter turned 20 last month and we would like to bring her to the US with us. Because she is a potential age-out, I have been told that it may be possible to succeed using a fiance visa and making the application "RUSH POTENTIAL AGE-OUT." It's important to file now to allow enough time to get all approvals and complete the interview so that her daughter can enter the US before her 21st birthday. I am not sure however about whether there is a requirement to be living in the US for the initial filing of the I129F. Does anyone know specifically whether it's okay to show my current address in China on the first forms, and then later, after the petition is approved to move back to the US to establish residency?
  6. When my wife came to the USA we did not bring her son. We are now wanting to bring her son. Do any of you have any experience with this?
  7. If my fiance's daughter is turning 18 this september, does she still qualify for the visa under the fiance visa? Do we only have to start the process before she turns 18? My fiance will be coming to the U.S. in July for 6 weeks. Is it legal for us to marry while she is here? If we marry, how does this affect the daughter coming here?
  8. If some of you've been following, lawyer messed up our app. I need to call USCIS tomorrow (per USCIS employee suggestion...30 days and no action) and see where we are at. But as I read everything I have a question. Rosie legally doesn't have a visa. The K1 expired (Feb 19) 90 days after she entered the U.S. Is she still able to go forward with the I-485? On the 485 the attorney typed in OVERSTAY as the status of her visa. Your thoughts? Sorry I ask so many questions. I just need to make sure I do everything right after he botched it the first time. Additionally, does someone have a link of a site that shows us exactly what we need to do to file the I-130 for her unmarried daughter that's 20 years old? What papers do we need to send in for that when we can send them in. We are going to do this all on our own. No more attorneys.
  9. Well Rosie got the letter of confirmation a few days ago that she was approved for the K1!!! YEHAAAAA!!! But now I have a few question. I listed her daughter for the K2. She wasn't able to go to the interview with her Mom because she was in England studying. What's the steps now to get her the K2? Also Rosie has to go for another physical because it's been almost 6 months now. And exactly what does she do now to get the visa? She has to go to Guangzhou so I assume take the letter and her passport and there ya go? Any info would be greatly appreciated!!! Have a great day!!!! Marc
  10. My friend Jeff is getting married to Chinese woman on June 26,2010. Here is his question. My fiance came to the US on Apr 29th. Her son did not accompany her but wants to come later. Can someone please tell me what he has to do since he has turned 18 since her arrival. Also what do we have to do on this end? What forms need to be filled out besides the I-485? He was included on her original K-1 visa application. Thanks, Michael
  11. We applied for her SS Card today. No problems with her. But her son (11 years old) needs work authorization before we can apply for his SS Card. He is K2. The lady at the SS Office said that Yan can work after she gets SS # in about 2 weeks, because she is K1 attached to me. Is this true? I was understanding that she would need to wait 3 months for Work Authorization. we are not complaining! She is very bored sitting at home.

  13. AOS for K1-K2 has been pending for some time now. My question is whether when approved does a child's status change to allow for a SSI#?
  14. My I-129F is in progress (I hope). My SO has a 20 year old son she wants to include in the Visa process. When does the K2 process begin? Once the I-129F is approved? Is there something I can be doing now to expedite this process? Thanks in advance for your comments.
