  1. Hey TY99, I'm not trying to debate against your position above, as in fact I tend to agree with your position, but I have had problems when contacting USCIS over the phone. They've insisted each time to talk to my wife first, and only after asking all the prerequisite questions and asking if she gives permission for her case to be discussed by me then am I allowed to ask the questions to USCIS. Have you encountered that? Or are you able to directly speak to USCIS about your wife's case over the phone, without your wife present to verify her info and give consent? You're absolutely right on that point. Lance. I just didn't get into any detail about it but what you say here is exactly what I experienced. Thanks for spelling it out.   2. I agree too, that the I-864 wouldn't come into play or enforced against the sponsor for unemployment benefits. That would be absurd. The only way the I-864 would be used against the sponsor is if the beneficiary was to collect means-tested public benefits such as food stamps or welfare checks (TANF) and then there's stipulations involved with that. It is all in a "gray" area in which no one wants to go to.
  3. Congratulations, Hank! The IO was right about the G-28. There was a thread going around a couple of weeks ago about the G-28. Some people have submitted the form but I was told a long time ago that they are usesd in a professional capacity, like an attorney used for representation. I never needed one to talk to a USCIS rep about my wife's or stepdaugher's case. As for my wife, she only needed to be present whenever I talked to them. A G-28 is not needed in a marriage based visa case unless it involves certain circumstances. Anyways, there's my take on it. Congratulations again!...
  4. It'll never work. Obviously, you forget who you are dealing with here. You can forget about a visa if this is the path you choose. Your case would take years to conclude with the government. Much more longer than it would take to get a visa. The government can stall it forever. And don't forget; they come to this site now and again.

  6. To take it to the extreme, it could take as long as 7 months. It seems someone posted that one time but that is an extreme. To be more down to earth with it, I would say anywhere from 2 weeks to 2 months. Hopefully it will go fast for you and not get bogged down in red tape. -good uck
  7. Letters, emails, and pictures are needed at a K3 interview as well as a K1 interview. You have to prove that the relationship is bona fide. As you have said, "give them the kitchen sink." I'm not sure I'm following your logic about not needing any of this information. It has always been needed. Thos items are what is needed to prove a legitimate relationship otherwise, with the high fraudulant matters found in GZ, they will deny you. That quick, that simple. Anyways, don't sweat it. Do whatever the blueslip says to do and do it quickly. That is the only way to ensure the issuance of a visa. -good luck

  10. What a great guy! I received a bunch of pu erh tea from Steve (slw268) today. He sent a great selection of it, one brick is so beautiful, I would feel bad breaking it!...lol.   11. So K-3's have to wait for their I-130 approval to get the green card regardless, pure and simple. That was the way I always understood it. My I-130 was approved 7-2003 and I filed the I-485 for my wife 12-2003 along with a copy of the I-797C approval notice of the I-130. That's just the way it was.
  12. Or the I-485 is handled at MSC, and the I-130 is handled by CSC or VSC may also have something to do with this. Also fee for I-824 like others went up to $340 (Seems to be random if USCIS automatically sends the I-130 to NVC or holds it for AOS) Ah yes. I forgot about the fee increase. I guess that at least substantiates part of what I have said, "things are always changing."... I also like to point out to yixuan that I recant my previous posts. I think you will be safe. I apologize for my comments but I was only erring to the side of caution without understanding the many changes that has passed concerning the USCIS. Your post was the first of its kind and it caught me a bit off guard. I couldn't understand the CIS approving the I-485 before approval of the I-130. In the past it was always the I-130 must be approved before filing the I-485.
  13. I think the latter is more realistic than the former in this quote. I don't think an Immigration Officer has any latitiude to enforce the approval of an I-130. It's too marred in political red tape and the IO is just another employee of this tremendously large agency. Sounds like he is going to be in CIS purgatory for quite some time. Yep, I advised that they should renew their EAD. I've been thinking about this thread since I first read it. At first, I didn't understand how the USCIS accepted the I-485 without an I-130 approval but I think I may have stumbled onto something. As usual, things are always changing. Putting 2 and 2 together, maybe the approval of the I-485 before the I-130 has something to do in the change of moving forward with the I-130 instead of the I-129F/K3. You know, now you have to file the I-824 form and pay $200 to process the I-130. Maybe that is the reason for I-485 approval before I-130, no?

  15. I missed it all together! I forgot it was coming on and I wanted to see what shots they got of China! I can't take the show seriously concerning China's turmoil history, however. To me, it's kind of disrespectful to the people of China, them and their ancestors. It's not like past survivor shows that were filmed in the Australia's outback or the ones with the "Pirates of the Carribean" theme but this one is in China. How can they mock China in this way? Like Dennis, if they really want to know what survival is, let them experience the China of the '60's! Anything less is child's play!
  16. Right, Dan. I am not eligible to apply for I-485 until I sent I-130 together with it or with the NOV1 of I-130 if it has been applied earlier. So do you think that will affect my I-485 interview without a NOV2 of I-130? Thanks. Probably not, the IO should look over all the paperwork, and approve pending the I-130 approval, this should cause the I-130 to get expedited. I would not worry too much, just bring all the paperwork submitted with the I-130, the evidence used for the I-130 proves eligibility. I hate to be the "bad news bear" but I have to think differently since the I-130 hasn't been approved. Firstly; how did the I-485 get approval before the I-130? And secondly; LPR status cannot be obtained until a visa number is established to the immigrant by the state department. The approval of the I-130 constitutes this. But the bottom line is whatever the IO says at the appointment. Opinions in contrast is what makes this site great. A question is answered from all angles giving the OP options and ideas to look at. -good luck

  19. That's some good information, Tom. Some very good points but wouldn't the visa officers detect fraud during the interview appointment? That's what they're trained for. You don't hear much about it but I bet they have stopped many fraudulent cases in GZ alone. Of course, they don't catch it all but I think most cases are where a couple have irreconcilable differences and the one returns back to their country, namely China in are cases. It would be easier for K1 then for K3 or IR1. K1's aren't married. They have 90 days. (i won't go there), But K3's and IR1's are married which makes it more difficult, (children, divorce, property, etc.) I think the IV unit in Guangzhou does a good job in nabbing fraud. I think some of them are good enough to smell it! By catching fraud, it saves everyone the grief. But if not, I think you've made some excellent points that people can go by.

It's a fabulous city rich in history and beauty. It is the home of the monkey king. No one has ever mentioned it before. I visited it and had a great time! The people are friendly and the food is wonderful! It's the only city in the world that I walked around openly with a quart of beer! I was scared to death! In the US I would've been arrested and detained!

There was a time when you could mail you passport along with a visa application to the Chinese embassy in D.C, or any of the consulates and they would give you a visa and mail your passport back to you. All for $35!... Now you have to find a travel agency to do it for you or go to the embassy or consulate yourself. The agencies typically cost around $200.
  22. The approval of the I-130, (NOA 2), is needed. The approval allows for a visa number to be assigned to you. The NOA 2 is needed when filing the I-485. I'm not sure what the IO will do at your appointment or how the USCIS even accepted your I-485 without the approval notice. Yes- take your NOA 1 and marriage certificate. Let the IO sort it out for you. -good luck
