  1. We got an I-797 NOA today after getting her EAD and AP this weekend in the mail. The NOA says: "in order to speed up the processing we have transferred the above case to the following USCIS office for processing: California Service Center..... That office will notify you of the decision made on the application or petition." So... what does that mean? No interview?
  2. I am a little unclear what to do now. The NOA says to wait for another letter with the date of the biometrics appointment. But the FAQ's here mentioned that I should call in and schedule our appointment for biometrics when the NOA arrives. Anyone????
  3. Hey Dan, How did you deal with attaching / including the I-693 Medical Envelope?
  4. So how should I attatch the Medical envelpoe? And I thought the Acco fasteners were the preferred method of binding things together..... which requires punching holes. Is there a better way? I'm open to suggestions...
  5. I am putting the AOS packet together to send out this week. Couple questions: I am (of course) usiing Acco fasteners to attatch it all together. What is the best way of including the passport photos with the packet using the Acco clips? I was thinkin about using ziplock baggies... And what about the sealed Medical envelope? Can I get away with punching to holes in the envelope for the Acco? Thanks!
  6. Also, how in depth do I need to get on the Avanced Parole question in Part 7. I'm not really planning a trip for sure, but since it is included in the filing fees, I thought we should do it just to have in case she needs it. But what should I write here?
  7. Can I just photocopy the certified birth certificate and certified english translation? Or do I need to send in the original?
  8. Yes, it is the visa type. On ours, I put K-3 Visa for my wife and K-4 Visa on my daughter's form for I-485.. The expiration date is the date on the US Visa attached to her passport....Issue Date on the left and over to the right, Expiraton Date. Both of ours were 06-01-10. For a K-3 and K-4, the expiration date on the visa is the same as the one on the I-94. However, they are asking about the visa date, not the I-94 date. Best wishes. They seem to ask about the I-94 and Current status expiration, which would be the date on the I-94. Visas must be used before the expiration, but the status extended by the visa expires on the date on the I-94. That's what I was wondering.... Does it matter that the I-94 has expired? That was my concern: I didn't want to cause problems by entering an expired date.... So is it the Visa or the I-94....?
  9. I'm assuming "K-1 Visa holder" will cover it. But the expiration date is is throwing me...
  10. What should we put down in the "Current USCIS Status" box on the first page? As well as the "Expires on (mm/dd/yyyy)" box next to it? (Is that referring to the I-94 expiration?)
  11. So... Is this going to get us in trouble at some point? She has been working since the first of March, and at least one place is employing her as a contractor, and filing a W-9...
  12. But K1 visa holders are authorized to work on entry, right? That was my understanding, anyway. I sure hope so: my wife has been working for the last month and all they asked for was her SSN so they could file everything accordingly with the IRS. Is this going to cause us problems in the future?
  13. The I-131, I-864, I-485 all want an "A #".... G-325A wants a file number that begins with an "A", which i assume is the A-number again... and I-765 wants an "Alien Registration Number (A-Number) OR I-94 Number... if I have both, which do I use, or both? Thanks!
  14. They "seem" to know what they are doing. The told me that since it is only a K-1 visa, they only need to fill out her vaccination portion of the form. The said nothing about a TB, and I asked them about it. The lady I talked to seemed pretty knowledgable about the K-1 process, and familiar with the differences between the varous visa types. I'm hopeful.
  15. Cool. That was my next question: We are going to the Civil Surgeon on Friday - All we need to take is her vaccination record and passort, right? For some reason I was thinking there was medical info about her physical in GUZ that we needed to take with us, but the took all the medical info at POE......
  16. Cool. So I can just make up the dates and file it with AOS anyway, right? Should I even bother to estimate the dates we might leave, or just but down anything?
  17. So we were going through the paper work from the consulate as we're prepping for AOS, and my wife brought me a paper she had not previsouly read that was a warning about packing X-rays in luggage. And I feel like an ass. I even thought about it after the interview, but with everything else happening, it slipped my mind when we packed to come home. So how screwed am I? And what do I need to do to fix my foolish mistake?
  18. That's what I was thinking, but I am still not sure how the advance parole works. ie: How can I apply for it when I don't have a scheduled trip to give hard dates for? Or is it one of those things you just make up dates and they give you and open ended permission slip? I just don't know...
  19. I'm not sure if I need to send this in with AOS. She has no intention of going anywhere anytime soon (possibly next year for Chinese New Year), but if I don't apply for advance parole, when is the earliest she can leave and come back? I also don't know if I can apply anyway since we have no intended dates of departure....
  20. He guys, long time no post. I'm been living the sweet life with the new bride, settling in and getting things in order to send in for AOS. We finally got her second round of immunizations here in the states after waiting a month after the first round. It worked out well because we had to wait a month to get the official Marriage Certificate copies anyway. I'm making an appointment today for her to go see the Civil Surgeon to get the I-693. But I was wondering if there was a simple, comprehensive "Kitchen Sink" list for the K1 AOS. I just want to check and double check what I am doing. Better safe than sorry! THANKS!
  21. Okay. I get that. I guess I don't get how the EAD works. How long does it take to get the EAD (if it is approved)? And does it come back before the AOS? And if so, how long until the EAD expires? (I was just assuming that the EAD would be good for the same time as the I-94 - which would still be less than 60 days...) Sorry I am so confused.... but thanks for helping.
  22. EAD can take up to 90 days to get. NOTE: DO NOT apply for EAD before AOS based on K-1 visa, this will get rejected by USCIS because they will not be able to approve it within the 90 days of the I-94. EAD based on K-1 expires 90 days after entry to the USA on the K-1, a tremendous waste of $340. Yes EAD based on an pending I-485 is part of the $1010 fee paid for AOS, you will use code (c )(9 ) on the I-765 for EAD. Okay, thanks. But, if I am understanding you correctly, I'm screwed. Based upon Kansas Requirements, I won't be able to get her a State ID until after AOS - because even with EAD, she still has no new "Date of Exit" until the approval of AOS... Right? Or am I missing something here?
