  1. Refer to Q/A number 3, If K3 visa holder think the CR1 process will be completed in near future, so they prefer to wait in China for IV interview. If the medical reports and notarial documents are less than one year old at the time of the IV interview, will the consulate accept this medical report for IV purposes? (assuming all medical reports and notarial documents are still in K3 Visa package sealed by consulate)
  2. We thought the K case name check process has completed before NVC send it to post. If "the name check process has already been started at NVC" means NVC just initiate the process, would you hold the sending of Packet 3 forms or scheduling interview process to wait for the results? What is the validation period of the name check results?

When IV applicants having their medical examination in Guangzhou healthcare facilities, the panel physician facilities check their materials for completeness and putting the documents in the proper order and place them in a sealed envelop for interview. These Hospitals insist the DS-156/DS-157 forms must be filled out by hand-writing rather than Adobe Reader filled while there is no such requirement or enforcement from other cities¡¯Consulate appointed facilities. Would you please clarify if this is mandatory requirement (Fill out DS-156/DS-157/GIV-24 by hand-writing) or it is just some hospitals¡¯own policy?

    Assuming mail signed by White-Swan Hotel doesn't necessary mean it is received by IV unit. To help us track the returned Packet 3 forms, would you please let us know the mail pick up schedule?
  5. Would like to add question #4: If an I-864 submitted to NVC for CR/IR IV has expired (longer than one year when it was signed & notarized) by the time of returning to China for interview, will applicant need to present another notarized one (alone with the most current Tax Return)?
  6. Dear USCONGUZ, Most people received DS-156/DS-157 form set in both English and Chinese. We notice on your website the NIV unit encourages applicants to use online filing of DS-156, then hand-write Chinese character for their names and addresses after form is printed. Also there is bilingual version of DS-157 which can be downloaded from your website. Since IV packet uses these forms, could we use the NIV filing method and only bring the English form of DS-156/DS-157 to interview (DS-156 with barcode sheet)? There is question relate to GIV-24, Family Composition Sheet. Some folks of petitioner have English name only, what should applicant put in question#7 while it asks names in Chinese character and pinyin? Thanks in advance for your kind answer.
  7. Just want to clarify, after March 1, 2006, currently signed I-864 only needs ONE sponser's tax return for year of 2005. And it needs to meet 125% Poverty Guidelines of 2006. If an I-864 was signed, notarized from last year, or before March 1, 2006, it also needs to meet 125% Poverty Guidelines of 2006. NVC has required sending in the original, signed, notarized I-864 which eventually will be forwarded to GZ post. We also need another notarized one for interview?
  8. It all gets started by one of 001 member who recently applied for her domestic CR1 petition in Beijing USCIS office. She submitted the most-common-use notary certificates for birth and was told to bring in the other kind, ChuShengZheng GongZheng, or call Notary certify of true copy of the Chinese Birth Certificate. It scares lots of 001 members to dead. People can't distinguish between Beijing USCIS office and Embassy, since both are in the same building.
  9. Since it will follow the same guidelines as with the I-864 to prepare an I-134, may I just present you the I-864? Most couples have filed both CR1/IR1 along with K3 petition. At some point of time there is I-864 required by NVC. If applicant's K3 case is ready first at post for interview, would you accept notarized I-864 instead of I-134?

My step-daughter would have been here LAST June under a K-3 and not still waiting for an interview. 195567[/snapback] Thanks USCONGUZ, The original question was cut short and here to provide you the true meaning of that question: Since when p3 of CR1 just being send to GZ station, still has 4-5 months to get an interview because of security check and other administative process. So combining K3 and CR1 means delay. All I want to ask is that can consulate send a letter for applicant to ask if she wants to pick up K3 first before automatically void the K3. she might be willing 5 months later come back to pick up CR1? You are right, no one wants to stick with K3. If during K3 interview you could give her CR1 instead, then there is no question at all, everyone happy.
  11. Unless the CR1 papers have arrived at station (GUZ) you proceed with the K3 unless you choose to cancel it. If the K3 is not yet issued and the CR1 petition arrives at station, the K3 is automatically cancelled and the CR1 proceeds. The K3 is only available "when an immigrant visa (CR1) is not immediately available". So when the CR1 is at station, K3 is no longer available because the CR1 is immediately available. Clear as mud? 194530[/snapback] Explanation is clear as crystal. Problem is "when CR1 is at station", it will still take 4-5 months or even longer to complete. In this case, we don't want "K3 is automatically cancelled" happen and ask for ways to keep K3 live. CR1 can proceed, people can get this visa later (compare to change status in US, this could be faster). We heard people holding K3 in US then came back for CR1 interview, how do they manage to get this around?
  12. Most of us did not make clear decision when fill out form I-130 whether or not choose CR1 in GUZ or pick up K3 then change status in US. We all expect the process of CR1 will take longer time than K3's. By the end of 2005, USCIS speeds up their approval of petitions, we have seen lots of cases that CR1 and K3 both sending their packet 3 to GUZ at close time. It results in K3 being canceled / combined to allow CR1 continue but will take additional 4-5 months to get an interview. What is the procedure or how do we inform GUZ that when above occurs GUZ will not automatically combine two processes but let someone pick up K3 visa first then interview for for CR1 wherever he/she is waiting in China or US?
