  1. Randy is right about the K1...if you don't want to get married, and maybe if you file the K1 now...it would not be long after Dec. that she would have her interview......... Tom and Ling There's an additional factor here. Before he can file the CR-1 and K-3, he must go to China (Aug 2008 on his current plan) and get married. The K-1 can be filed now.
  2. Another factor to consider is where you File the Petitions: The Cal. Service Center has time lines for all I-129F K1, I-129F-K3 ,and I-130 as doing December 18, 2007 However, Vermont Service Center has timelines for I-129F K1 and I-129F K3 as December 18, 2007,,,but for the I-130 they are only on the July 30, 2007 So..it seems also a difference what Service Center services where you live, since only two service center handles these petitions. I think that either the K1 or K3 will be about the same time line, but it won't be just 5 months........ Tom and Ling
  3. Hi jimu07, Like Randy suggested....If you are in China or you want to marry and moved to China for a couple of years......why even do that. If you can move to China for a couple of years, Why not just go to China and marry in China, and than you can do a DCF (Direct Consulate Filing) in China. Seems to me that if I was able to live and work in China, and my wife wanted to live in China for a couple of years...I would be on the first plane over there and marry her over in China....just my opinion however.   5. If there are Kids involved, than the K3/K4 is the way to go, or one would have had to put an I-130 in for every person that was going to Immigrate to the USA...In my case I would have had to file three I-130's. Tom and Ling

  8. I would agree with Darnell, Rob, and Smitty, Keep it simple since you have not attached it to the I-130. I included an EOR with my I-129F, was it needed (Who knows) but did it anyways and will have one (much longer) for the interview, if Ling and I have to do an overcome. Frankly...Erika..I don't see ya'll having a big problem anyways, but in this interview thing..One has to cover all bases..... Now, about that TC addition... And the Wok..... Tom and Ling AHHHHHH.   11. For the son...We are all saying the same thing but differently Tom and Ling As a K-1, she will not need a visa number. She can file for Adjustment of Status as soon as they are married. She MUST go the "green card route", or leave the country. It will most likely take less than 1 year. As soon as she gets her green card, she can file the I-130 for her over 21 son. She does not need to wait until she becomes a citizen. the application will be upgraded to son of an American citizen when she does. The son must wait for an available visa number. This will take about 10 years, but only 6 years if she becomes a citizen in the mean time. He MUST NOT GET MARRIED while she is an LPR. He CAN get married after she becomes a citizen, but it will delay his application by a couple of years. Check the Visa Bulletin
  12. I wonder what you are asking in this post??? If it is about the son...Than there are two ways to go once the mother is in the US. The first way is she needs to become a US citizen in 3 years and than file a I-130 for the son which will take 1 to 2 years, so as early as 4 years if they are lucky to probably 5 years. Going the Green Card way will be quit long because Green Card holders have to wait for a Visa number. I am still not sure how long for a US Citizen to file for an unmarried son?? I get the impression that you are asking about the 70 year old guy and the 50 year old woman, and those two filing an I-129F-K1, and does the man at his age ....should he even file for a K1...is this what you are asking??....I guess I am confused about what you are asking??

Hi BrokenHeart, Congrats....But it is the NOA2 that takes the time, and since we have filed about the same time...It will be interesting to see how fast the Vermont Service Center works since I also filed with the Vermont Service Center...who knows, we may be in Guangzhou for our interview at the same time.......   14. Hi tsap seui, Ling and I just got married in March 2008 in Lings City of residence. The Chinese government use to require that the Chinese citizen marry or register their marriage in the capitol city of the province where they live which would have been Nanning rather than Yulin City. But in Nov. 2007 the Chinese government allowed registration in the City of residence. So I did two things, since I had to go to Washington DC and the Chinese embassy anyways...I wrote out my own Single status affidavit and had it notarized in North Carolina ,had it certified by the the State of North Carolina and finally by the Department of State. If you have the Chinese embassy certify this affidavit you have to have all three done, check out the information about marriage in China on the Chinese Embassy in Washington DC. So, I had the affidaivt from the Chinese Embassy, but it wasn't translated in to Chinese, but I did not have it translated. I had also contacted the US Embassy in Guangzhou citizen services and they said they would do an affidavit too....So when I arrived in China I had an affidavit done at the US Embassy. And the reason I used this affidavit was that they said that allot of times the Chinese will accept the affidavit without translation. So what I need to provide was a filled out affidavit, birth certificate, my divorce decree (an here is where the US Embassy will accept a notary from county where you live), and my passport. My future wife just had to provide her national ID number plus other information on her part of the affidavit and since they would not let her into the American service area, I just had to provide her ID number along with information about her. Got the affidavit with the Consulate blessing, I decided to use this affidavit because I think they would keep all the information on record about the affidavit. Marriage in china is very simple, you just go and register your marriage and you are married. For registration of the marriage, I just need the affidavit, passport, divorce decree (although I forget whether they took this), and Ling need her National ID, certificate of her husbands death. An we had to get a marriage picture taken (we got 10 copies) they need one for each marriage book (little red book) and in about 20 minutes you are married. Tom and Ling
  15. Also...There is nothing that your step-son needs to fill out or sign, but make sure that you include him on the I-129F as one that will come with your wife. Tom and Ling

Well, I missed the fact that you got married and I now know you did, and Congratulations on getting married...Now that I know this there is also the I-130 that has to be filled out first.....So make multiple copies of the I-130 and have Jian tell you what applies to her. as well as she has to give on the forms both I-130 and I-129F in her native language. I take it that Jian is a nurse is that correct?? So, you need to get multiple copies of the I-130, I-129F, and the G-325A. also..because you got married so soon after meeting Jian in person, When you get back to the States to file the I-130 first..I would also include an evolution of relationship in both the I-130 and the I-129F. Also they will require you to supply affidavits from friends and such. If you have anymore questions, you can contact me off line or ask on this web-site. Hi Richard and Jian, If you have already filled out the I-130 ,than download the I-129F and make a few copies and Have Jian tell you everything on the I-129F that applies to her...but one important thing is on the second sheet they ask for in her native language and I had Ling do multiple copies of these forms...because I am not good at Chinese. As far as the G-325a goes..just remember Five copies of each. Hope this helps and as others have said...Get about 10 passport photos of her so just in case.....   18. Hi TaijiMonkey, I am in the same boat with the change of address. My wife wants to move from Yulin City to Nanning and I have given her the OK. Since I am fully supporting her and she has quit her job as a nurse...I didn't see any reason to stay in Yulin City because her parents, brothers ,and sister live in Nanning....... I was advised by other CFL's to send in a change of address to all the different Agencies when I know where she is going to live in Nanning. See http://candleforlove.com/forums/index.php?showtopic=31170 And that is what i am going to do...Basically, put a change of address with new address and old address , but also give the number that they have given our petition. From what I have read the NVC give a different number on the petition when it is sent to Guangzhou...so be prepared to give this number. I don't know at what agency my petition will be at when my wife gets her permanent address in Nanning, but since I will be going there in September than I can always give it to the US Embassy in Guangzhou since we have to go for another reason too. Some people might be interested in why my wife and I have to go to the US Embassy in Guanghou in the first place. I wanted to withdraw some money from my 403b account and I was going to withdraw some money...when Fidelity said "wait a minute bud" you are married so you have to get your wife to sign a release form before you can withdraw any money....So I have to go all the way to China to get wife approval....beats all, but I was going anyways..so it is working out...... And Fidelity says they won't accept a Chinese Notary...Has to be a consular notary.... Tom and Ling How do I get them a change of address? And should I start preparing for the next step? (And what do I DO to prepare for the next step?)
  19. Hi Carl, I just checked with the processing time for a US citizen filing for a parent. It will take about four years for Lei to become a US Citizen. This is how longer it took my second ex-wife to become a US Citizen, and it looks like one more year to petition for a mother to come to the US..so it looks like at the minimum 5 years...I hope this helps.....   20. Hi Carl, I'm afraid that Lei is right about the long time..... There are only two ways to get a mother into the US..One is a visitor visa or tourist visa, but the US doesn't give these out if they think the person is going to stay in the US. The other way is Lei would have to become a US Citizen which will take about 4 years just to become a US citizen...three years to qualify and one more year to get her Citizenship. Than Lei could petition to bring her mother over here, but even this is not first preference so the wait could be long... If Lei chooses to stay a permanent resident it will even take long than going the US citizen route. I don't want to be so negative, but this is just the way it is. This is why it takes a long time to get our wifes over here. Tom and Ling

Hopefully, this won't be a problem since she should have an apartment before September and I think the petition will still be at USCIS, but I might be surprised also............ Tom and Ling Just an idea, but maybe you could change the address to her parents mailing address if it's reliable? I don't really know if it would help, but maybe that way you don't have to worry about things getting sent out while you move?

I thought I had very thing covered and had filled out all the forms including the online Visa application and now I have to do it all over again and I can not do anything until she gets a permanent address in Nanning. Hi All, I seem to have a problem...My wife now that she has quit her job in Yulin City is now going to move back to Nanning where her parents live I am not too upset , but for the I-130 and the I-129F, I have given her address in Yulin City. So, I would guess that I have to wait until she has a permanent address in Nanning before I can really do anything....is that correct?? I have time and since I am going there in September ,this can be worked out, but is there any form that I or she would fill out for change of address with in China?? I can understand why she is doing this, but it does create some problems as far as we need to have her permanent address set before the packet 3 is sent out. So have any of the CFLer's had to deal with moving from one city to another with in China before the packet 3 was sent out??? Tom and Ling
  24. Hi Darnell You have that right, China does have the craziest Traffic and while I was there on my first visit..I wondered why more people were not Killed... Tom and Ling I can't possibly imagine why you would not want her to take driving lessons in China - if she can drive THERE, she can drive anywhere in the world - China has the craziest traffic.
