  1. i did the same thing u plan to do. i went for a k1 in guz, and that got turn down. now i got marry in HK and going for a K3. I think i stand a better chance in HK. 1. if u going K3, u are going with her to interview together. you will be right next to her. 2. they process faster when the package come from USA to HK. 3. HK is part of China, i see no reason why the VO are so damm stupid. 4. if u r married one or twice before.. u stand a good chance that you will see a blue sheet. 5. HK have better hotel, and lot more things to do than GUZ. 6. GUZ Vo is really Nasty.. they prejudge you even ebfore the interview starts.
  2. the 1st time i spoke with Mark Ellis, he keep telling me not to cancel my old i-129F. the reason behind that is to find out why it was denied and try to frontload that on the new application. can you have 2 I-129F being process in nvc? i know that eventally the old one need to be cancel. Peterd01, from looking at your timeline, you are just a month in front of me. i just sent my I-130 a few days ago.
  3. I just send out my I-130 yesterday. I'm planning to go with a K3 since we got denied. Now the K1 came back to the USA to be review and is pending, no result yet. The question that i have is when should i send a letter to cancel the I-129F ( fiancee ) before i send the new i-129F ( K3) out to USCIS?

  6. i just started email them again, all i keep getting was your case is beening sent back.. and USCIS will look at it. damm i hate that. I emailed them everyday,I told them I wanted a supervisor to look over my case.I made sure to let them know I was an american citizen,(important,to let them know this)A thing everyone seems to forget,tell them your an outraged an american citizen,because the way they wash away their errors,well the beneficiary is not a citizen,she has no rights,in fact,it states on your NOA2,a visa is not guareenteed,ah yes,but you my friend,you are an american citizen,something forgotten in this process,I told them to give full access to my congressman and senator.so we can get to the bottom of this.My last email,i wrote a pretty heart wrenching story,what my wife and I do every day and night to show we love each other, compared to ,How most american couples come home plop themselves on a couch in front of a tv set,hardly saying a word to each other all night,and this is called a relationship.And each night when i come home,my wife and i are excited to sit in front of a computer screen with a webcam and a microphone,and share our dreams,and hopes.And then we shut down our computers and go to bed and cry ourselves to sleep.This of course is my story,you will have to tell yours.I can Email you the actual email i sent,but you got the idea,and just maybe you will finally reach someone with a heart,and do i dare say....."feel for you" because Brother you and I know this is totally wrong,something know one on hear can truely understand,except for those of us who have been subjected to this"trying to catch the bad guys" give it a shot,be firm,but not combative,or threatening,of course polite,tell them also,that this affects not just one person,but two lives,one of which (again)An american citizen.And that other person,at least in my case IS Legally my wife.See,what is happening,to them its just a job,the woman that walks in for the interview,look!!! i am sure they have seem some winners,honest to God scammers,ones truely after the green card,and after awhile they become numb,to them all these woman who happen to be our wifes/ girlfriends ect...They walk into the interview, they are looked at as dirt,i am sorry to put it this bluntly,....to them,these woman must be all looking for the so called almighty green card.could they actually be in love ? Ah there all a bunch of liars.Did you read my last post,one guy came on "inquisitor" his comment was.....if you could only speak english and hear what the "wives" are really saying amongst themselves....insinuating again all are this way !!!! this is what we are up against,this is a real mindset....look I been on 001 website,i have heard some horrifying things,but......i hear also nice things....You and I know there are bad guys out there.....but when they catch a good guy and say thats a bad guy(i am using guy generically speaking,of course i am talking about our dear wonderful ladiesWho have been treated badly) for the most of 2 weeks i got generic letters,your case is being sent back to USCIS for possible revocation(am i spelling that right?)well, you know the letter.   9. Thx for the info, i want to go for the K3 because i heard that if she get interview in Hong Kong, i can be with her at the interview. I don't need another disappointment from GUZ. ans also i'm not worry about SSN, because she was here in the USA before and she has a SSN.
  10. i know that the I-130 Fee is about $350, so when you file a I129F after do you need to pay $450 fee or is it free?
  11. When my finacee went to the interview, i forgot to list my chinese name on the sheet, that was a instant flag. So as Marc ( the lawyer ) told me. This is his exact words. Consulates cannot deny for reasons known to USCIS at the time it approved a petition. So when you refile - it is VERY IMPORTANT to explain everything to USCIS up front - in the petition - before it is approved.
  12. I don't understand something. I-130 is for spouse. And I-129F is for Fiancee. if your marry, how can u still file for a I-129F? NM, i did some research.. that a K3
  13. According to mark, for every denied, The VO officer must write the reason of the denied in detail. That will be sent back with all your forms back to the USA. Buy since USCIS is way too busy to look and investigate , they will just let it die. So to find out and fix the issue " Mark will need to request the denied form via "Freedom of information Act". Once we obtain it then the appeal process begins. ( BTW: if a chinese woman marry a Vietnnes guy, that is a big red flag, that's what happening in my case. as my fiancee ex husband is from there ) Once the denied issue from case #1 is resolve, GUZ can't bring up the same issue again to denied the vias. That's where the CR1/I130 comes into play. The I hope this whole nightmare will end and she will be in the USA. yes, this case will cost me a bundle of cash and help the US economy. But i want my Fiancee/wife here. Who is peter? Did you get to find out exactly why you got denied? ok,with the "freedom of information act"how do you go about getting the actual reason behind ones denial,beside the "not a bonafide relationship",my wife scanned and emailed our white slip,it says nothing,except "not a bonafide relationship" and goverment bla,bla,bla,bla,bla,bla.is there a documentation by the VO,of what actually was the reasoning for giving the denial.?My thinking is,yeah the information act" you will probably get a document looking like that of the "Roswell ufo incident document" 90 % blacked out.maybe i am cynical.   14. Sorry to hear received a White Slip. Seems like i'm in the same boat. I started filing a K1 for my Fiancee a year ago. Went to interview in April of 2008, received a Blue Slip Overcome Letter sent in April 2008. After 5 months of wait and constant email sending, i finally got a email back from GUZ telling me that my realation is not Bono Fide. After all the sadness and anger surpass. i went on several different fourms to see what are my options. I finally call Marc Ellis and was suggested to not to terminate my Current K1, but to Provide evidence to uscis to resolve any issue with it. Otherwise it will bite me in the ass if i file for a CR1. In the mean time I can go ahead and get married in china and re-file for a CR1. This is where i am at at this point. Talking to marc make me realise that after getting a denied from Guz, there is a very slim chance that one can fix the issue in GUZ.( depending on the situauton). One will need to wait for the file to get back to the USA. the UScis will lte it expired. the only way u can find out why they denied you is to use the Freedom of information act to obtain the document. My fiancee call the office that Peter worked in GUZ, but as all might know.. Petere no longer work there anymore.

  16. benc I will tell you something. The reason they do not tell anyone the reason(s) for the denial is that they do not want to give away their trade secrets. If they did this then the scammers would get a leg up on them. I waited 18 months for GZ to send my denial back to the states and now it sits at the CSC just waiting to expire. Once the case has expired then you might can find out through the FOIA if you are lucky. More that likely the reason the CSC lets the cases expire is because of two things. Most couples opt to marry and try the marriage visa or they just simply break up. The CSC puts these cases on low priority. Also, the ones that have been fortunate enough to find out the VO's findings usually end up getting BS reasons. For example, one case I know of, the VO said that the couple had no form of communication. The interview was held in English and the woman had been an English teacher in China for 20 years. I think it is in best interest of you and your woman to try and figure out the reasons between yourselves and plan for your future. Some of us have to wait longer than others and there is nothing we can do about it. Waiting is not so bad in the grand scheme if things. Good luck!! I want to get marry, and i would do it in a heartbeat. but without finding what kill my k1 will kill my CR1. i think i will work with Marc to see what can be done. thx for your comment.. i feel less frustrated and start to think what's my next move in this long Chinese Chess Game.

  18. How come GUZ don't tell you the reason why they denied you? Is there a way to find out the reason why before the file get sent back? And if it get sent back will they tell me the reason why it got denied?
  19. So from reading this thread, I assume that if you get a NOID, It wound make no sense to hire a lawyer, he would not be able to do anything for me in GUZ. I would just have to wait for the file to come back to the USA for the appeal process. Is that correct? While the file is being sent back, is it possible to just abandon the k1 and just get marry and file for a CR1?

  21. To my understanding, Peter no longer works in China. I think he is now back in Seattle. I have personally visited his office twice in the last few months in GUZ, but everytime a woman (who claimed from Seattle as well, spoke fluent English) said Peter is on vacation, but will be back. She took my information and said Peter will call me. Few days later, I got an e-mail saying she can help me as they don't know for sure when Peter will come back. I insisted that I will wait for Peter and want to e-mail him directly. After many talks, they didn't give me his e-mail address and say his e-mail accounts all broke down. That lady said she is from Seattle too and works just as good as Peter.... I ended up not getting service from them. You are correct, when my SO call them, they told her that Peter was on vacation in another country.
  22. The question i have is, if i get married in hong kong ( CR1 ). I'm a dual citizenship in HK and USA and my fiancee is a china citizen. when the interviewing, where would it be ? in Hong Kong or in Guangzhou ?
