It was received on Jan. 2004 and still waiting. my wife's K-3 will expired in June. if she still not received her GC, what happens next? and is it possible to renew the K-3 visa? and how to do it? frank1538 Posted November 8, 2004 Report Share Posted November 8, 2004 I'm not speaking from experience, but I don't think the K-3 is renewable. Like you, we filed for AOS but off a K-1 which is now expired. Technically, my wife's status is considered a "period of stay authorized by the Attorney General". This means that she is here legally but in a kind of limbo while we wait for Atlanta to get its act together. From what I've been told, nothing can or needs to be done other than wait. tywy_99 Posted November 9, 2004 Report Share Posted November 9, 2004 You can apply for a K-3 visa extension by filing an I -539 but it isn't necessary unless you all plan to travel out of country. Since you have filed the I-485 with CIS, your spouse is now in the 'pending' status. I forget the actual terminology but I have posted this situation here a few times before. Link to comment
