does my wife to be us citizen if she wants my social security?

if i pass away, and she still not us citizen, would she get my social security benefit?

 

 

Yes - as long as she has lived in the U.S. for at least 5 years, she can get full spousal benefits. I think that is true for as long as she stays in the U.S., even without the 5 year restriction.

 

If she moves to China, then the 5 year restriction applies, and I believe she will will have to travel to a consulate once a year in order to continue drawing benefits.

 

I'll know more later this year when I go to the consulate to apply for my own benefits.

Did your wife live in good ol' USA for at least 5 years?

 

She got a Green Card and gave it up? My wife is not happy with that prospect.

 

 

No, she didn't. We are considering moving back to the U.S. for 15 months to make up the difference if it will allow her to draw benefits after my death.

 

My understanding is that if your wife remains in the U.S. after your death, then the 5 year rule doesn't apply.

Wife is still Chinese citizen.

 

If wife lived together with me for over 5 years in US of A, does wife get spousal benefits for life?

Even if she lives in China and is Chinese citizen?

Even if I kill-over?

 

We'd like to retire in China, and neither of us has any plans to return to USA unless required for SS benefits for her.

Wife is still Chinese citizen.

Yes - one of my regrets is that I wasn't aware of this when we moved to China. I assumed (wrongly) that she would be ineligible after moving to China, although it probably wouldn't have changed our plans.

 

If I remember correctly, one of the benefits calculators shows this. (Maybe not).

 

SS is now pretty much entirely online - I haven't had to check in at the SS office (which moved to Manila), OR the consulate.

Leaving the Country

 

Social Security will continue to pay survivors benefits to non-citizens if they leave the country, with some important conditions. It depends on reciprocal treaties and agreements signed by the United States and the country where the survivor moves. If your surviving spouse is not a citizen of a country that pays social insurance benefits to US citizens living within its borders, for example, the survivors benefit stop after the survivor has been outside of the United States for six months. A survivor who is a citizen of France, for example, would be eligible for benefits just as if she remained in the United States; a survivor from Ghana, however, would stop receiving benefits six months after leaving, as there is no agreement between the United States and Ghana.
