Questions about filing I-864 &DS-230

Hi all,

My wife (a citizen now) applied with an I-130 for her daughter (over 21, unmarried) who lives in Shenzhen. We recieved the approval (PDF via email)of the visa petition from the NVC last October 15th 2010. Is the deadline to send in the I-864 and DS-230 a year from that date? We have paid the fees but we are still getting all of our "life stuff" together so that when we send in the apps it shows the best possible situation for us.

 

Also,it was my wife that applied but I would like to become the co-sponsor because I will have a job and she won't. What's the procedure for doing that? Is there a form that I need to send to the NVC? Do we fill out two I-864's?

 

I'm also just about to start a new job. If I work for a temp service is that seen in a bad way?

 

Does anyone know what the wait time is between sending in the apps and the interview date?

 

Lastly, do I need to be working at that same job (or making the same wage) on the day my step-daughter goes for the interview? Or just until she gets the interview date?

Approval from USCIS or I-864 Request and Visa number assignment from NVC?

 

If just approved by USCIS last October it will be some time before NVC will request I-864 and assigns a visa number to the case.

 

Anyway yes you do have up to a year to respond to NVC requests, if need longer it would be best to contact NVC and see about an extension.

 

Your best option is to opt in to electronic processing with NVC see: http://candleforlove.com/forums/index.php?/topic/37703-i29fk3-changes-and-nvc-electronic-processing-for-i-130cr1/ (This will shave a few months off of the time.)

 

As for affidavit of support, wife will be primary sponsor and provide an I-864, your income can be added to that of hers by simply adding income numbers and putting on her I-864 your Joint IRS returns aslo reflect joint income. You can also provide an I-864A, but I believe you don't have to as a spouse.

 

As for wait time, time from sending DS-230 + foreign docs to an interview can ba about 2 months if doing e-processing as indicated above.

 

As for working same job, your status as of filing the I-864 is what matters, NVC processes the I-864 and the consulate may want to see the original I-864 + financial evidence at time of interview.

dnoblett, yes it was the I-864 request and visa # assignment from NVC. We got that on 10-15-10 and so I paid the fees for both apps right away.

 

Yuehan 123, I see, so it's not from the approval date but from the date of any kind of contact? That's good to know.
