Anyone do emergency A/P?

Ling wants to return to China for New Year's but Chicago seems to have ground to a halt (again) for A/P. Anyone have experience filing the emergency application?

My wife's filed twice the past 11 months withs just the regular application. AP was received within three weeks each time. I think a cover letter explaining the emergency my get some expidited consideration.

Just a question about this matter. Could the chinese person travel to China before the form is received since it is just used to return. If she was going tp stay there for a few weeks, could she have you fed ex it to her and then use it when she returns. Or is that too risky? I have no idea about that but have wondered myself.

I wouldn't recommend leaving the USA without the proper paperwork in hand.

BCIS definately says not to travel before applying as bad things might happen. Perhaps one could travel before it was accepted, but I think that would be risky..... Don't want to start from scratch with the application process again.

If you are applying for adjustment to permanent resident status, you must receive advance permission to return to the United States if you are traveling outside the United States. This advance permission is called Advance Parole. I agree that you should have the AP in hand. My wife just left today to China for the New Year's. I'm hoping when she gets back in March that the Chinese POE's won't cause too much of a hassle with their lack of knowledge about the AP.

Ok I kind of thought along those lines anyway. I am just glad we don't have to worry about that since we were CR-1.
