If you have a two year green card, you'll need to remove conditions and get a 10 yr card. Your spouse can start the naturalization process around 3 years of continual residency in the US. I believe he/she can can start applying for naturalization 90 days prior to the 3 year mark

3 years? I thought you can apply for the citizenship after the first green card period which is 2 years??

Three years...

 

If you have a 2 year conditional card, you need to first apply to remove the conditions by filing an I-751 and all the evidence of still living together with spouse. Then 1 year after filing to remove conditions you can then file an N-400 for citizenship.

 

By the way,is it "easy" to get a 10-year green card?? :rolleyes:

Not renewing, you file an I-751 to remove conditions.

No problem. You got a little ahead of your self on the citizenship thing, but yep first need to get the 10 year card.

i been reading on this topic regarding n-400 for my wife. we welcome your feedbacks, comments and suggestions as always.

 

so correct me if i'm wrong:

4 /2009 wife enters usa

5/2009 wife has 2 yr conditional green card

3/2011 wife files i-751 to remove conditional green card

10/2011 wife has 10 yr green card aka permenant resident card?

11/17/2011 wife went to china

1/17/2012 wife returns to usa

5/1/2012 wife has 3 years in usa and she can file for the n-400?

Correct.. The N-400 can be filed within 90 days prior to 3 year anniversary of residency, about 1 year after you filed that I-751..

 

Period of time visiting China will have no effect on this since it was less than 6 months.

 

In my wife's case she took a year to decide on filing the N-400
