AOS for K1 - Getting Started

Hello,

 

 

Rather than trust the often confusing and conflicting information on the government websites, I would appreciate it if anyone with experience could help with a brief overview of what we need to do next. We were so focused on the K1 process that I'm feeling a little unprepared for the next steps.

 

So far I know we need a I-485 and I-864, which required 3 years tax returns. Anything else? Do we need to wait until we are married to fill these out?

 

Thanks everyone, it's been a hectic few days since Limei got here, my brain is scrambled, and some direction would be much appreciated.

Start with this guide, this is what we used when adjusting status.

Also add I-765 for EAD "Work Card" and I-131 for travel document. They dont cost anything when based on pending I-1485.

 

A few pointers, send only photo-copies of evidence, do NOT send your originals.

Perfect, this is exactly what I was looking for. Am I correct in assuming that we need to be married before submitting these?

Yes, the AOS is based on marriage to US citizen. You are adjusting status based on the K-1 visa and the K-1 is for marriage in the USA, you need to compleate the purpose of the K-1 before adjusting status.

 

One item needed to be attached to the AOS package is a copy of a completed marriage certificate. NOT a license.

Yep, don't forget to get the vaccinations done and/or record transferred to an I-693.

Ok, so we have a little yellow book called the "International Certificate of Vaccination or Prophylaxis." I am assuming we just need to send this and an I-693 to a civil surgeon? Should I be able to find one locally, or do I need to get in touch with Dr. Arnold in Austin?

You should be able to fine one locally.

They may need to do a TB test, and if she is younger than age 27, HPV may be needed.

 

Call around, but insist on vaccinations ONLY, many doctors and their receptionists on the phone like to quote a FULL Medical, sometimes you need to visit the doctor with I-485 a,d I-693 directions in hand and point to the paragraphs stating K-Visa only needs vaccinations record done.

 

The doctor in TX tends to do them for $30 or so.

Hi...I hope you or someone can help with this I-864 question. It is question 21F in the household section. It asks if I have ever sponsored anyone in the past on the I-864 form. And I have, back in 2001...but don't know if it was upon the I-864 form, if the person is a US citizen now, her whereabouts or how to contact her (ex wife). So therefore, I don't honestly know how to answer the question, or whether to put a number down or not. Maybe I should write immigration a letter along with the form? This is being done for my adjustment of status, my wife's that is. I have no paperwork or records from the past sponsorship other than the divorce agreement. Thank you much for your time. Ok, wedding went great and we are belatedly getting started on all of this. Should my wife use her maiden name, or my last name which she wants to start using? We just opened a joint checking and savings account with her using my last name, and she doesn't plan on using her Chinese family name anymore...

Yep, if she wants to take your name, then use married anme on form I-485, and G-325A, and on I-485 where it says "Name on I-94"use maiden name, and on G-325A where it says "Other names used" use maiden name.

Ok, looks like we screwed up then. We were talking with an attorney and she advised us to list her married name under "Other names used"

 

My wife does want to take my surname, but I'm guessing we'll have to wait until we get to the US and file the I-90 along with our marriage certificate. Is this correct? Stinks that I could of avoided spending the fees it will take to do this. :rolleyes:

Possibly, I would first mention this to consulate before interview by email, or at interview.

 

Other options are I-90 after entry to the USA, or if married less than 2 years upon entry, and you get a 2 year conditional care, you may be able to file to remove conditions using married name.
