tsap seui Posted August 1, 2009 Report Share Posted August 1, 2009 Yassuh, I gots me the letter today!!! Our K-1 application is on it's way to Guangzhou...again. My wife n' I is Soooo happy. Oppps, what the hell am I thinkin'??? We're already married...DOLT Anywho...the USCIS re-approved our K-1 in June of this year and the NVC just sent me a letter tellin' me The NVC has reviewed your visa petition.The assigned US Embassy/Consulate General forwarded you correspondence/information to the NVC. The National Visa Center has been informed that the USCIS reaffirmed this petition. As the NVC had previously completed the processing of this case, the file will be forwarded to the U.S. Embassy/Consulate listed below. Now ain't that jest the cat's meow, I must ask ya? Hmmmm...too bad it wsn't a year ago. It's only been 24 months since the lil' rabbit had her original interview. Now, we've got 2 approvals from the USCIS and 2 approvals from the NVC...their good for front load material for the next round at GUZ's lucky ducky pond drawin'. I just started my application... if fact I will be happy if I can mail out the compleated packet to the lawyer this week. ( any advise for me?) I am so impatient to have her here with me! lol..... I was hoping to have the proccess take only 9-10 months.... I hope we are not waiting 2 years. I am happy things seem to be moving for you now. I wuz jes lookin and I saw that it took 35 months from our interview until the USCIS sent me notice saying we could file our K1 again. Should I do it.........huh????? Jon & Cindy Jon, that was funny as hell. Robert, sorry for the confusion and please don't have fear for your case. I'll give you a sorta timeline. When I filed our K-1 application back in November of 2006 it only took ten months to get to the interview. At the interview we were given an Administrative Review type blue slip. AR blue slips ask for no further evidence. You just wait We waited 10 months for the DOS to deny us with a white slip. Never got the chance to defend ourselves. From the denial it took 11 months for the DOS in Guangzhou to send our denied case back to the NVC. Then another two months for the case to be forwarded back to our Service Center in Vermont. Within 2 weeks the USCIS, without ever sending me a letter with the charges against us from the DOS, and giving us the 33 days to rebut those charges, NOPE the USCIS simply looked at the case and said the DOS had no good reason to deny us in the first place...our lucky ducky didn't get pulled out of the moving pond at our interview. Now, since the USCIS reaffirmed us, the NVC didn't even bother to re-check us and just sent the application right back to China. The USCIS is the entity who has the last say on a denied case. According to an attorney in the know...in our case the USCIS in effect is slapping the DOS in the face and telling them they never had legal grounds to deny us back in July of 2007...can you imagine that? You will be okay Robert, don't fret over our bad luck and wasted 2 years. I now own a home in China, will soon file a CR-1 application and head over to live with my wife and son in China while we await the next interview. At least we now have the fact that we have already been approved twice by the people that really count. Good luck to ya buddy, there was never anything wrong with our case other than just not our lucky day back there in July of 2007. That doesn't mean that you aren't gonna be lucky. The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 15 days from July 30, 2009, please call customer service at 1-800-375-5283 for further assistance. Reading your story just breaks my heart, and I have to say ... you are a strong man indeed to still have a sense of humor about it.
