david_dawei
technically speaking, K#s fall under the 100% and CR# fall under the 125%. but since a K# will, after approval, soon need to meet the 125% during AOS, it's best to anticipating being held to that expectation. Link to comment
HelloWorld08
so the tax that will be used is 2008, does that mean we follow the 2008 poverty guideline? Link to comment
david_dawei
Anybody who has an interview from this point forward should assume 2008 is what a VO is most concerned about. So, even as a CR1, if someone sent an I-864 to NVC, prepare a new one for the interview based on 2008, just in case the VO requests it. Link to comment

They will more then likely extend this law so the welfare and the Ponzi Social Security benefits will not be raised. Link to comment
DanP
The 2009 Poverty Guidelines for the48 Contiguous States and the District of Columbia Persons in family Poverty guideline100%----- - 125%1 $10,830----- $13,537.502 14,570 ----- $18,212.503 18,310----- $22,887.504 22,050----- $27,562.505 25,790----- $32,237.506 29,530----- $36,912.507 33,270----- $41,587.508 37,010----- $46,262.50For families with more than 8 persons, add $3,740 for each additional personalso I read if you are short of mimium you can cover it with assets in the amount of 5 times the shortage you have Well, these numbers will be obsolete soon, but these numbers are direct from USCIS for 2009(note the bold, it's higher than above): 2 $18,212 3 $22,887 4 $27,562 5 $32,327 6 $36,912 7 $41,587 8 $46,262 add $4,675 for each additional person http://www.uscis.gov/portal/site/uscis/men...00048f3d6a1RCRD http://www.uscis.gov/files/form/i-864p.pdf maybe i'm reading it wrong, but shouldn't it be three times for spouses? What Cash Value of Assets is Needed? To be counted, the cash value of assets must equal five times the difference between the sponsor's income and 125 percent of the poverty line for the household size. For example, a petitioner/sponsor with a household size of four and an income of $18,000 would need assets equal to five times the difference between his/her income and the income required for a family of four at the current federal poverty guidelines level. He/she would also need to show evidence of mortgages, liens, and liabilities against the assets. The cash value of assets required is different for these sponsors: Sponsors of immediate relative spouses and children of U.S. citizens must only show assets in the amount of three times the difference between the poverty guideline and actual household income. Sponsors of foreign orphans who will acquire citizenship after admission to the United States need only prove assets in the amount of the difference between the poverty guideline and actual household income. http://travel.state.gov/visa/immigrants/in...What_Cash_Value Edited June 5, 2010 by DanP (see edit history) Link to comment
