Melanie
Hi. Do we need to file the EAD first, separate from the AOS package? It is my understanding that her son will need this first, before being allowed to recieve a SSN. Link to comment
georgeandli
In olden times[last year] when you filed EAD concurrent with AOS the filing fee for EAD was waived. That's why most folks go that route. If you want the SSN only for tax purposes, look into getting an individual tax number for the lad. Link to comment
dnoblett
File for EAD with AOS package, there is no charge for EAD that is based on a pending I-485 (C )(9 ) The I-765 only indicates EAD can be filed based on Fiancee (Which MAY include K-2) or based on pending I-485. If you file based on visa class (K-1, K-2) the resulting EAD costs $340, and expires 90 days after entry to the USA, this EAD usually cannot be approved before it would expire so is a waste of $340. warpedbored
What Dan said. I'll only add that you are correct. a K-2 unlike their parent K-1 can't get a SSN without either having a green card or an EAD. Link to comment
