MikeXiao Posted February 17, 2009 Report Share Posted February 17, 2009 After your wife recieves her citizen certificate, the children under 16 become citizens automatically. They can file the N-600 to get their certificate. They also can file to get a US Passport. We filed, but now need to get a letter from the 'X' to allow them to have a US passport. Good law, but written with a broad pen. Assumes that all 'X'es are in the US and the parent with possession of the children will run away to another country with the kids. Link to comment

My wife's decree, did not state that she had sole custody.Another option is a step-child adoption revoking the ex's rights, most states will do this if there has been no support or contact for 2 years. With us we had a 30 day waiting period and 30 minutes before a judge and it was a done deal. Link to comment
