If my wife applies for citizenship, how does her daughter apply. Does my daughter apply through a separate N-400 or on hers. Is there a separate fee?

MRMC,

 

1. After your wife receives citizenship cert. her daughter can submit

N-600 and pay that fee to the USCIS.

 

2. Or Just apply for a US passport.

 

We did #2 no problems.

After your wife recieves her citizen certificate, the children under 16 become citizens automatically. They can file the N-600 to get their certificate. They also can file to get a US Passport.

 

We filed, but now need to get a letter from the 'X' to allow them to have a US passport. Good law, but written with a broad pen. Assumes that all 'X'es are in the US and the parent with possession of the children will run away to another country with the kids.

I have not heard of of the letter being required from the father. We just sent a translated copy of the divorce decree stating wife has sole custody. We had no problems.

That works too. My wife's decree, did not state that she had sole custody.

Another option is a step-child adoption revoking the ex's rights, most states will do this if there has been no support or contact for 2 years. With us we had a 30 day waiting period and 30 minutes before a judge and it was a done deal.

This fall or next spring, we are going to do the same. I should have done this earlier, but with work, citizenship prep and all, just ran out of time.
