Principle of Consular Non-Reviewability

I hate to say this but I think I'm in the same boat. I started talking to my fiancee online april of 07 we met dec of 07 and I proposed to her. Durning the interview they asked when we met and she said dec of 07 so that was one of the reasons they denied our visa.

 

Even though I have spoken to many of you on here I have never met anybody and it was the same with my fiancee we started talking almost every day online for six months before I met her in person and they said since I proposed after meeting her within the 2 weeks I spent with her in Ho Chi Minh they denied our K1. Even though we had emails, letters and phone calls prior to the meeting and in a notorized statement I said we started communicating april of 07.

 

Now when I marry her in a month from now and refile they might be able to throw that back in our faces if they want to still deny us but from what I have seen most people have been succesfull the second time and thats what I'm counting on and if your in the same boat as me you should be hopefull that your second time will get you the visa also

 

Some are of the opinion (and I agree) that one of the tactics GUZ uses is to deny in cases like these to see if the couple will come back a second time. The theory being that non-legitimate cases will likely give up and serious ones will keep at it. It sounds like you're definately in the latter category and should have a much better chance the second time around. Good luck.

 

Dave, this is exactly the thought that Chawls and I came up with over a year ago. It's just a time game and a persistence game when given a white slip...we called it "the two year wait"...and look at Chawls and Charles successes, which took them about 2 years.

 

All those butterflys in the halls on the first 4 floors inside the consulate building, you know, the ones everyone likes to diss and call crooks....they are the "real oldtimers" and they have a saying, "If 10 people get a white slip, 6 or 8 couples will lose each other."

 

Futhermore, not all of those people with their tenacles trying to drag you into their offices are crooks. Think about it...."who is really doing the grunt work on the USCIS paperwork and P-3 and P-4 paperwork....americans?????? Not hardly....so who does that leave to find red flags and inconsistences that ultimately set your lil' lady up for AP blue slips and white slips?????? You got it, Chinese workers.

 

Ah rhe 20/20 hindsight :lol: If instead of going to the damned american consulate's ACH to plead our case to some jack-off lying sonuvabitch lowlife american, I should have been going to talk to the Chinese...THEY are the ones who can help you...but you've got to be quick and do your homework. Their offices aren't cheap, how do you think they make their payments...if they didn't have some successes what Chinese woman would hire them. Too late (my fault) the lil' rabbit went back to that hellhole called Guangzhou and found a man who had been in business for 15 years, and who had stacks of pink slips and red passports with visa stickers in them laying on his desk...and he didn't ask for any money up front...how do you think he's been paying his rent and buying his 2007 BMW???

 

I was too slow, and I made the fatal mistake of trustin' my government to do the fuckin' right thing...for 300 fuckin' days I trusted the lowlife scum of american government under the guise of the DOS.

 

If instead of trusting DOS lackeys, I had gone the day of the interview to interview those Chinese visa"s pecialists" everyone loves to hate...we would probably have gotten a visa in two months. :lol: See, they don't deal with dumbassed americans in the consulate....no, they deal with the people who really call the shots and can get things "done". :P

 

While I'm laughing my butt off as I type this and await the lil' rabbit to call me....let me say...all the white slips that have shown up by actual posters on Candle....this is NOTHING NEW!!!!! It's been going on for years and is business as usual with GUZ....good God, I've now gotten 16 white slip people PM me last year and NONE of them post on Candle.

 

A white slip is gonna take ya pretty much two years, anyway you cut it....but your chances of success at the second interview is a helluva lot better than your first attempt. :D

 

Hopefully the smelly ass of the DOS won't get stuck in anyone else's face. :) If it does, you can turn it into some highly tasty lemonaide, I'll gaa-rone-tee ya. :yahoo:

Just got caught up on this thread. Post 24 brought up the same thing I was told when wading through the NOID stuff. Perfect logic by GUZ. If money[visa fraud] IS involved the parties will give up. Only legit couples will keep at it, right? IF the petitioner stands to make 30 or 50K one would think there is MORE incentive to keep at it.

 

Just my thoughts on this matter but if someone is in it for the money and gets a denial, I would say they better give up and run for the hills because ifn they get caught, then life will change. :D

They need to start doing more investigations and locking people up for this type of fraud because many people are suffering that are legit and shouldn't be.

 

In Ho Chi Min the rate of getting the visa is under 50% the first time and Im not sure what it is the second time. I'm sure its much higher for legitimate couples since you would research it more the second time and find places like this and visajourney to help guide you threw it the second time
