Applying for Green Card

My friend and his fiancee from Nanjing are getting married and will need to apply for a Green Card. Can someone send me a couple of webpages to refresh me concerning the process? I have to send him an email and get him started as soon as she gets here at the end of Feb.

 

Also, what is the timeline - how soon after the wedding does he need to submit the applications? (his wife and his stepdaughter)

After getting married, they will need to file either an I-129F for K-3/4 visa or I-130 for the CR-1/2 visa. Of course there are many forms that will need to accompany the applications. Like the G-325 is one that comes to mind. Also they will need to send in the marriage cert. and since they get married in China it will need to be translated and notarized.

How is that for a start?

Timeline? I called USCIS about this once and the answer I got was kind of ambiguous answer. Once she is married, the K1 is expired. She is not necessarily 'illegal' but she is also 'not legal' but rather 'out of status'.

I was told that after 6 months, then she would become illegal. So really, it should be filed within the 6 months, however, the best answer is as soon as possible after marriage.

 

As for timeline to interview and GC, I think it varies from state to state. Colorado on average is about 3 months.

Marriage does not expire the visa, K-1 is a single use visa it is VOID the moment it is used to enter the USA, after that the I-94 clock starts. Marriage does not expire the I-94 either, I-94 is legal status for 90 days after entry, only then does the alien becomes out of status.

 

If they used K-1/2 to enter the USA, wedding needs to happen within 90 days of entry, then file for adjustment of status ASAP after.

I stand corrected.......totally spaced out that I-94.
