social security benefits

Recommended Posts

My wife has recently told me that several years ago she worked for a company but did not pay social welfare tax. She wants to go to another city where she can find work and pay this tax. She wants to collect her benefits starting at age 50. It is my understanding that the benefits are given to the women at age 50 and to the men at age 60. I told her that I would give her the money to pay the back taxes but she told me that I already give enough paying for the house we just bought.

Does anyone know if it is possible for the wife of a USC to collect USA social security benefits when the husband becomes deceased (kills over) while living in China?

A lot of companies in China fail to pay the required social insurance taxes for their workers. Unfortunately, an individual cannot just decide to pay these on their own at a later date. She'd need to go through the administrative process at the labor bureau to force her former employer(s) to pay.

I may be wrong, but I think that if one is qualified to collect US Social Security, it doesn't matter where they live. I know of retirees living overseas who get their social security check every month. Probably worst case scenario is that she has social security direct deposit the money into her US bank account and then have the funds wired to her in China.

Quite right Bill...US SS benfits are paid to eligible USCs whereever they live...Now if your wife is also a USC there are no issues...If she is a green card holder she is entitled to the same benefits as long as she maintains her permanent resident status...Now HOW much she collects depends on, of course, how much the USC was collecting, WHEN he elected to begin receiving benefits, and the age of the widow...again... Now how does one maintain their permanent residence status if she is living in China with only a USA green card? Does this mean that she will have to live in the USA for a certain amount of time each year?

Chawls, I reckon if'n you get the lil' lady hooked on Luck's pinto beans and them Vidalia, Georgia onions, she could just make a trip to Uncle Samville once a year or every 6 months to restock. Maybe that would fit the requirement for residency, and also help keep the lower intestines flushed with fresh air...so to speak. :)

Ah now you better head back to the pinned topic about permanent residency/visas/etc...This seems to be a vast unknown though...The language is really unclear as to how EXACTLY to keep a green card... :whistling:

I remember reading on an INS website very specific requirements and and exact play-by-play synopsis of how to maintain USA PR.

If I am not mistaken, you shouldn't be out of the country more than 2 years and have to maintain some kind of permanent nexus.

Try doing a Google to see if you come up with the site.

Maintaining Permanent Residence

Maintaining Permanent Residence You may lose your permanent residence status if you commit an act that makes you removable from the United States under the law in section 237 of the Immigration and Nationality Act. If you commit such an act, you may be brought before the immigration courts to determine your right to remain a Permanent Resident.

You may be found to have abandoned your permanent resident status if you:

Move to another country intending to live there permanently.

Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

Fail to file income tax returns while living outside of the US for any period.

Declare yourself a ¡°nonimmigrant¡± on your tax returns.

So there's the official blurb fom the INS/BCIS/USCIS...or whatever they're calling themselves this week..."However in determining whether your status has been abandoned ANY LENGTH OF ABSCENCE from the US may be considered..." sound downright unfriendly to me...And how long do you need to be in the US??? Not a word about that...People have told me two months but why??? Can't you fly in, get stamped and fly out again... :D I wish we had someone here who had done this for some period of time to see how it actually works... :D

On the SS survivor benefits thingie of course there is an age requirement for the surviving spouse as well unless they are caring for a minor child...

I know now no to depend on our gvt for anything anymore. I'll just keep paying taxes so they can squander it how they wish. :D

I did mention this to my wife and she said she would give the money straight to the government herself as she would not trust her former employer to do this.
