Claire
Hi Guys! I just want to make sure I get this clear; when you send in the I-129F, will the USCIS check if you are currently employed and that you make over the poverty level for two? Last year I made less then the required amount for two, but this year I am making over $20,000 after tax. So if they do look at this which I positively think so, my question is will they check for last years money or this year? I won't petition for a K1 until July; I assume if I petition by July, I should get the NOA2 by late December-January and my boyfriend should get all the required documents in January/Febuary. By then I will probably get the W-2's from my two jobs, pay tax, get my employer's to write me the recommendation letters telling how much I make and so forth for the year 2008. Get back to me asap. Thank you all. P.S. - I owe $890 in tax, will that affect me from getting approve for I-129F? Edited January 11, 2008 by Claire (see edit history) Link to comment
Guest Rob & Jin
Owing taxes doesnt matter, nor does that last year you did not reach the 125%.Its current income that counts, there really is no need to wait. Link to comment

You don't supply any tax information or the I-134 at the initial I-129 F submission. You supply the I-134 at interview time in GZ. Link to comment

You would not need the 134 until February or so 2009! Link to comment

Ok good. I totally want to start right away but I think I will need the w-2's for 2008 so that why I thought I should wait until mid month to petition, so that if i get the NOA by the end of the year, I will get the w-2's for 2008 in 2009. One question, what if I did petition right now and got the NOA2 in the summer or fall, and then my fiance gets his packet afterwards, is there a expiration date on the packet that you must turn in the necessary docs right away? If not will there be any problem if he gets the packet, and waits until I get the w-2's for 2008 next year and then turn in the packet to get schedule for the interview? Because I know the consulate will check for last year's income. So I have planned to use 2008 income in early 2009. Edited January 11, 2008 by Claire (see edit history) Link to comment

If you read the posts of those you have passed onto the promised land the 134 may be looked at maybe not. But being young and bringing a guy to here may or may not raise a red flag. So being extra ready is a good thing. The current time lines for USCIS is getting longer, so any time after April will put you into 2009 anyway?? Link to comment
Claire
Can the P3 wait if my fiance does get it before 2009? If there is no expiration date on there. How long does it last until expired? Because I need to 2008 W-2s and tax information for that year just incase the interviewer asks. Link to comment

You can return p-3 when you like, as long as petition has not expired. you can even request not to have a interview before april 2009.... or whenever. There really is no reason to delay filing Link to comment

Once you get the NOA2, how many months, before it expires? Link to comment
MikeandRong
Ok. Once you get the NOA2, how many months, before it expires? The consular officer will renew it, they know it will expire before they even get it (your case). You do not have to do a single thing for this, they take care of it for you Link to comment
dnoblett
USCIS is not concerned with your financial situation when the I-129F is filed, you need this info at the Visa interview. Link to comment
dnoblett
Ok. Once you get the NOA2, how many months, before it expires?NOA2 for I-129F expires 4 months after it is issued, HOWEVER, Guangzhou NEVER interviews for K-1 within the 4 months, they have authority to extend the validity of the K-1 NOA2, and they do for ALL petitions. Claire
Thanks guys. I'm just worried because if I filed for the 129F and then he gets the P3 right after that and I don't have my tax papers for 2008 when 2009 comes. Just want to make sure I have everything he needs at the interview. Thanks. Link to comment
