Expired work card

Does anyone have any experience with the above topic? If a person's work card has expired, and he/she still does not have the green card, what if the person keeps on working with the expired card?

 

I would guess they would be in violation of the law. my wife took time off her work until her card was arrived in the mail, which luckly was about a week.

I-9:

If employees are authorized to work, but are unable to present the required document(s) within three business days, they must present a receipt for the application of the document(s) within three business days and the actual document(s) within ninety (90) days.

If asked for proof of filing, show a receipt.

Interesting;

 

My wife's card expired on 2/28 and we are waiting for the new one.

 

She is working as a teacher's aid and is currently in a "volunteer" status as we await the arrival of the new card.

 

Question:

 

All she needs to do is to show her recipt for the new card to get

back on the payroll?

She needs to supply whatever documentation the school district requires, but yes, she could work now without any repercussions from the USCIS.

As Randy is suggesting.. it's really up to the employer and their interpretation and acceptance of a reciept or not. They are the ones who are responsible for employment verification/validation...

I would guess having an expired card is NOT "Authorized to work" and won't have a valid card until they issue her a new one. That is at least how I read it.

Just got the card on 3/19 with a validity of 3/12.

 

Looking at the online updates, it was approved quickly.

However the wait was long.

 

Lesson learned:

 

Apply for renewal about 90 days before expiration.

 

I wanted to do it in early December but my wife didn't want

to waste the money. I backed off and pressed the issue again

after Xmas.

 

Such a delicate process. :coolthumb:

would help since we were in the middle of the

renewal.

Not so easy if you live 300 miles from the nearest CIS office.
