9FAM is a bit vague.. just talks of "applicants" and it's not clear when they expect what for a k1...

 

The consulate site is the one I quoted... But have to be careful about this particuarly address, since it makes mention that the chinese versions are not needed, but I asked GUZ and they said for K# visas, they are needed in chinese as well...

Thanks to all of you. I just received information that clarifies this whole issue. You cannot imagine the anxiety that the mis-informed medical people have done to Lan and I in these few hours before our interview. Here is a quote from the US Consulate Website....

 

What documents will be in the instruction packet and appointment packet?

 

The Instruction packet in Guangzhou includes:

 

   1. Instruction packet (Packet 3) letter in English

   2. Instruction packet (Packet 3) letter in Chinese

   3. Application for immigrant visa and alien registration (DS-230 part I)

   4. Instructions for immigrant visa applicants (OF-169)

   5. Notice to all nonimmigrant visa applicants (list of CITIC Bank)

   6. Evidence which may be presented to meet the public charge provisions of the law (OF-167)

 

The Appointment packet includes:

 

   1. Appointment letter in English

   2. Letter to K1/K2 Applicant

   3. New Requirement for Nonimmigrant Visa Application Photos

   4. Supplemental form GNI-2

   5. Certification of legal capacity and intent to marry

   6. Family composition sheet (GIV-24)

   7. Medical examination instructions (GIV-8)

Be careful that this same thing does not happen to you....

Depends on how the "and" is supposed to be interpreted...

 

Could mean:

 

1) Document 1 and Document 2 (16 and over for #2 only)

2) Document 1 and Document 2 (16 and over for both documents)

 

I personally understand it as the first case, and your seeing it as the second case...

 

As randy once said to someone: "our collective fingers are crossed" :)

 

keep us informed on the correct requirements for k1...

The interpretation of item #12 on the US Consulate at Guangzhou website found here:

...is unlike the Bill Clinton interpretation of "it depends on what your definition of the word 'is' is."

 

Item #12 on the website clearly stipulates for children aged 16 and over. That means if the child is age 16 at the time of filing. Some discussions have ensued on this website and others concerning a child that has "aged out" during the visa process, meaning the child that turns 16 after the time of filing. It appears that the US considers the age at the date of filing rather than age at the time of interview. Neither event applies here for Lan and I, but for others it might. Bottom line is, you do NOT need to complete the DS-156 and DS-157 for K2 applicants under the age of 16. If you have it, it ain't gonna hurt, but again, as directed by US law it is NOT needed.

Actually in re-reading as David states it could mean that the DS-156 is required for ALL K2 applicants and that the DS-157 is needed for K2 applicants 16 years and over. Guess we're gonna find out...

The K-2 non-immigrant visa allows a child of your Fiancee to enter into the U.S. and await the availability of an immigrant visa.

    * seeking to immigrate to the U.S.

 

K-1 children may stay in the U.S. on K-2 visa for a maximum period of 90 days from the date of entry. If you and your Fiancee do not marry within 90 days, K-1 children must depart the U.S. together with your Fiancee.

Documents needed for K-2 visa:

 

    * Valid passport (not needed if child is under 16);

    * Nonimmigrant Visa Application (Form DS-156), in duplicate with two recent color photographs;

    * Official birth certificate;

    * Permission to travel from other parent;

    * Complete medical examination report.

 

You need to know

 

Generally an interview is required at the American Consulate. Some consulates do not require a child of your Fiancee to attend if s/he is below the age of 14. Many consulates require a child to attend even if s/he is not going to move to the U.S. with K-1 parent immediately, but will follow later.

 

The cut-off date for issuance of a K2 visa is 1 year from the date of the K-1 visa issuance to the principal alien. K-1 and K-2 visas are valid for one entry into the U.S. at any time within the next six months.

 

The child of a K-1 principal alien may acquire K-2 status even after the principal alien has married American Citizen Petitioner and acquired lawful permanent resident status in U. S.

K-2 benefits:

 

a. reside in the U.S. for 90 days until K-1's marriage;

b. study in the U.S.

c. apply for work authorization.
