Questions about CR1 interview

Nice to see you guys here to support and give so much useful info.

 

My wife and my step son (11 years old) came here in July last year on the K3/4 visa. Instead of filing for AOS, we stayed with CR1. And according to the proccess, we were told that the CR1 interview will be around this coming July. Since we have been married for over 2 years, I believe she would be able to get an IR1/IR2 visa instead of CR1, and here are my questions:

 

1. Will the consulate automanticly change her visa type from CR1 to IR1? Or she has to wait to do it at the entry of the US airport?

 

2. Since by the interview time, their stay in US will be over a year, so she has to get a police certification here in town, does anyone know how this works? what to do? is it hard to get?

 

3. I also believe by the time they get the interview date, their medical report paperworks will be expired days before. but if they get the date around middle of June, they may not need to do the medical exam again, but where can they get the paperworks?(I believe that we do not have any copy of it, it all gave to the officer of the port of entry), or they just have to go to the same hospital to obtain the copy of it which was taken last year? Has anyone done this before?

 

4. We are planning to move to another state, I thought it could be a good chance for me to move while they will be back in China. So when they come back, I already have things settled down for them. But in this case, considering getting her GC mailed to us, we need to inform someone/ somewhere about the change of address which we do not know yet?? Or she has to tell the officer at the port of entry about the change of our mailing address, or if there is other way to do it?

 

Suggestions and advices are very welcome, thanks a lot.

Hi Frank;

 

What I can tell you from experience is that, Bea and I were married and living in China and had been married for just over 2 years when she first intered the USA at JFK.

 

Her visa was a CR1 at the time she recived it in aug, married 2 years dec and POE in Jan of the following year. We did the I-130 ? visa not sure on the number so long ago.

 

The office at JFK made a notation on her paper work and on her actual Visa that she would be given an IR1 green card rather than the CR1, ( Conditional residency) that she qualified for at the time of her interview, (Aug.)

 

So I would assume and you know what that means..;) your wife would also be given the 10 year permenant residency IR1 Visa. I can also tell you that if this is the case, have her ask the official to make a large notation, marked attention etc etc.in her paper work. As Bea is still waiting since this Jan for them to clear up the mistake of sending her a CR1 green card when she should have recieved an IR1.

I'll take a stab at trying to answer some of your questions, but like everything else about the visa process, there are usually multiple views, so please don't rely on any single person's response. ;)

 

1. Automatic Conversion from CR-1/2 to IR-1/2. The consulate should give you the IR-1/2 class visa, but I would be inclined to drop the consulate an e-mail or fax to confirm that the visa class will be IR rather than CR. Also, take a look at http://candleforlove.com/forums/index.php?showtopic=17283 for some variations on the theme.

 

2. Police Certificates From the US. There seems to be a difference of opinion as to whether US clearances are actually required. http://foia.state.gov/masterdocs/09FAM/094...39;dsl1083' says no, but the information is a bit dated. This thread suggests US clearances may be required - http://candleforlove.com/forums/index.php?...topic=11191&hl= . This link re-states the "not required" view but then provides contact information to get one from the FBI: http://www.kamya.com/misc/polcert.html

 

3. K-3/4 Medical Reports. This is an interesting question, and one would think that a less than year old medical report obtained for the K-3/4 would be acceptable for the CR/IR visa. Of course, you'll still need to get the required vaccinations.

 

4. USCIS lay out a procedure for a change of address, using a Form AR-11: http://uscis.gov/graphics/howdoi/address.htm Also, don't forget the I-865 change of address for a sponsor who has filed an I-864: http://uscis.gov/graphics/formsfee/forms/files/I-865.pdf

 

With the exception of the change is address, the other three questions seem broad enough that I'll go ahead a pose them to the consulate (USCONGUZ) in its special forum ( http://candleforlove.com/forums/index.php?showforum=25 )
