  1. Dear USCONGUZ: My question is: Is it possible to file for AOS in USA and in the meantime the I-130 is still working too? So in this case, if we get an interview date in GUZ before AOS interview in USA, could we have an opportunity to choose to go back to China for the interview? Case type, K3/4, married over 2 years. Hi, all In early May, GUZ noticed us that our name check has been expired, so they are doing another name check for us.( IR1/2 case sent from NVC to GUZ in Dec 2005, got into GUZ computer in April, 2006, 4 months delay, do not know why???) Called DOS days ago, told us our case is waiting for the security clearance. Ok, have to wait. Called again today, they told me that our case is now "under administrative review", -----what the heck is it? Does it mean a bad thing?(according to what I read here, it seems is a bad thing).But what does it mean? and how long it is going to take? Should I be worried? Or should we do something else? Some friends suggested us to file for AOS here now, so we do not have to deal with GUZ any more. But I just do not understand why it is so difficult? Any sugguestions? Advices?Thanks a lot. Frank
  3. I think Lee makes a good point. Both the IR-1/2 interview and the AOS interview are aimed at conferring legal permanent resident status, so one would think that the proof of a valid relationship would be roughly the same. Personally, I would tend to treat them the same. Having said that, it would also seem that the IR-1/2 interview shouldn't be much different than a CR-1/2 interview irrespective of whether the K-3/4 visas were previously issued. Several members have gone CR-1, and the interview doesn't seem any different than for a K visa. The difference in your case is that your wife and step son have already come to the US, so that you should have additional documentation (joint accounts, health insurance, etc.) that would validate the relationship. I would certainly bring this additional information. As the commercial says: "Don't leave home without it." 221957[/snapback] Thanks a lot, guys. I surely will follow what you said. As th other Frank said, should treat it as a AOS interview to have additional evidence to prove the relationship. So now I know what more to prepare. You have been so helpful.   4. Hi, everyone My wife and son are going back to China for the IR1/2 interview, since we just followed our I-130 instead of AOS. We are trying to prepare ourself as much as possible, but we still wonder if there would be something important missing, or the interview would be a little bit different because they are already here. Anyone has experienced this before, having their wife gone back to take the interview? Any advices are very welcome!!! If you have any details of the interview, please share with us, we would really appreciate it! Thanks a lot! Frank
  5. Dear USCONGUZ: I have read some of the posts here regarding of I-864 and tax return, and I am a little bit confused right now. My questions are: 1. Do we need to take a updated, original and notarized I-864 form to the interview? Since we have already submited an original one to NVC in our CR1/2 P3, but it is from last year. 2. does the tax return form has to be original too and also signed? 3. Someone mentioned that in the P4 for a CR1/2 case, they also ask you to send the original form of I-864, and if there is any lack of original papers, it would effect the case approval. So in this case, we should at least prepare more than one original I-864 form, is this correct? 4. is the W-2 forms necessary to provid? Thank you very much for your help in advance. Frank
  6. Another additional question: How long does this name check take for CR1/IR1? According to what I know so far that the name check for K3 has already been done in NVC before they send it out to GUZ, is it correct? Frank
  7. Yes, it seems it takes longer than before. My case has been sent to GUZ in Dec. last year, and the case just entered into GUZ computer last month, and who knows how long it will take for them to complete the name check, mine is IR1. And about when we are going to get a interview date? It is really frustrating. Well, just hang in there. Another thing is so many people have waited for this long, but who knows what is wait ahead for them, red slip or blue? God knows. Frank
  8. As part of the CR/IR IV document submissions by the applicant to the consulate, does the consulate require an application fee receipt for IV fees paid to the NVC ? The consulate's website suggests that fee receipts are not required to be submitted - http://guangzhou.usconsulate.gov/iv_faq.html If fee receipts are required, will the consulate accept other documentary evidence, for example cancelled checks, if fee receipts cannot be obtained?
  9. Hi, all: Glad to find all of you here and feel so supportive in this big family. My wife and my step son (11 years old) came here in July last year on the K3/4 visa. Instead of filing for AOS, we stayed with CR1. And according to the proccess, we were told that the CR1 interview will be around this coming July. Since we have been married for over 2 years, I believe she would be able to get an IR1/IR2 visa instead of CR1, and here are my questions: 1. Will the consulate automanticly change her visa type from CR1 to IR1? Or she has to wait to do it at the entry of the US airport? 2. Since by the interview time, their stay in US will be over a year, so she has to get a police certification here in town, does anyone know how this works? what to do? is it hard to get? 3. I also believe by the time they get the interview date, their medical report paperworks will be expired days before. but if they get the date around middle of June, they may not need to do the medical exam again, but where can they get the paperworks?(I believe that we do not have any copy of it, it all gave to the officer of the port of entry), or they just have to go to the same hospital to obtain the copy of it which was taken last year? Has anyone done this before? 4. We are planning to move to another state, I thought it could be a good chance for me to move while they will be back in China. So when they come back, I already have things settled down for them. But in this case, considering getting her GC mailed to us, we need to inform someone/ somewhere about the change of address which we do not know yet?? Or she has to tell the officer at the port of entry about the change of our mailing address, or if there is other way to do it? Thanks a lot. God bless everyone! Frank
