  1. We filed $1010usd worth of stuff (sorry) a few months ago. Then,we received a letter instructing to go get fingerprinted in Tampa. Then,we waited. Then, the EAD Working Card arrived in the mailbox and my wife started LEGALLY working a couple of months ago. Thats it. WHATS NEXT??? Have I forgotten anything? I assume the next thing to happen is a letter will come instructing to go make Medical Exam (in USA) should arrive? Theres nothing more I can do-right? Just wait for the Med-Exam instructions to come in the mail? My wife has started pestering me about this so I had better have an answer for her tonight! (I think we are supposed to just wait for that Med-Exam letter, but every time she gets around "new" Chinese friends, and they start giving her "advice" about her Green Card, she starts getting impatient and militant towards me.) Demilitarized Duck with Plumb Sauce for dinner tonight!
  2. I think I remember some thread around here that discussed this issue. If memory serves me, this is a good thing. Usually a fast track with no REFs and no interview till the 10 year card?
  3. I have no idea what's going on with USCIS...... My husband entered into US thru K-1. As is informed, we just need to submit I-693A. However, after waiting for 4 months, we got a notice today that request him to submit the original DS-2053 (which was given to the custom when entering into the US) or HAVE THE MEDICAL EXAM AGAIN! Basically the reason for that is no medical exam could be located. We are living in NY. Anyone else has the same case? I guess we 99% will end up having another medical exam, which is really ridiculous!
  4. I posted this question over at VJ with no luck. So I'll try here. I had a question about the marriage certificate. On the I-485 instructions, it says to send in a certified marriage certificate, but I could only get certified copies of the marriage LICENSE. When I went to my county marriage office, they said the certificate is only for decorate use; there is no official use for it. When I had tried to get another "certified copy" of marriage certificate, they took my original one and gave me a new one which had nothing written on it (therefore I still only have one and this time it's unsigned and blank, strange eh?) So I just took back my original certificate and left it at that. I wasn't sure to send in the original certificate + another certificated copy of my marriage license? Or just a certified copy of the marriage license? Thanks!
  5. When the petitioner and beneficiary are married the child is over 18 but not yet 21. The petitioner can not file I-130 for the child, as the child was over 18 when the marriage took place. The petitioner files I-130 and I129F for the beneficiary. The child is listed on the I-129F and can come to U.S. with the beneficiary after visa approval. What is the process for Adjustment of Status for the child without the I-130 being filed by the petitioner? Thank you for your time.
  6. I guess it's about time I posted this. Leiqin has now been in America over 6 years without returning home. The good news was, she was given Asylum status, so she could stay forever. The bad news was that she could not leave the country and return. She would need her GC first. And, Asylees are put on the lowest priority. They typically may wait up to 8 years before receiving their GC. So, my first priority after marrying was to adjust her status, get her GC and send her back to China. We had our AOS interview last May. We're told the usual "Wait 6 months and if you haven't heard anything contact us." So we waited. Everyday expectantly checking the mail - nothing. November we have an INFOPASS interview. The officer tells us her biometrics has expired. Everything is on hold until she gets fingerprinted again. He could tell the look of disgust, disappointment and dispair on my face. I asked, "What do we do now?" Leaning down and putting my ear next to the opening at the bottom of the 1" thick plexiglas, I tried my best to hear what he said. I was happy to hear that he scheduled her for another fingerprinting not far from where we were in downtown LA today. I asked him what do we do after the fingerprinting and how long do we wait for her GC. He said something about scheduling another interview. I asked, "INFOPASS?" I think he said NO, schedule with another interviewing officer, but this is where I am confused. I really don't want to have to go through another year just to learn that there's something else missing. What do we do now, just wait? Any suggestions, information, advice would be appreciated. Thanks
  7. I applied for fiance visa and arrived in USA in Jan. Before I came here, I had my medical exam that required by US consulate for visa interview. Now I am applying for the adjustment of status and Form I-693 needed to be filled by doctor. Does anyone here know whether I need another medical exam for adjustment? Thank a lot for kind help.
  8. My wife got here on a K-1 Visa, and had the required medical exam in China on September 24. We filed our AOS application on January 6. Now we got an RFE saying that she needs to get a medical exam and send in an I-693. I called the 800 number listed and they were not very helpful. They said we need to send a letter back with the RFE if we want to dispute the need for an I-693 - saying my wife is here on a K-1 Visa (shouldn't they know that?) and that she had a medical exam in September 2005 and we filed the AOS in January 2006 (again, you would think they would know all of this!). Now the way I read the rules in the I-693 FAQ - http://uscis.gov/graphics/i-693faq.htm - for K-1 Visa's if you had a medical exam within 1 year of filing AOS, you do not need to get a medical exam in the US - nor do you need to send in the I-693. We did get her vaccines here in the US and sent in the Vaccine Supplement form with the AOS. So I am wondering what to do. I don't want to hold up our AOS application, which within the past few weeks got transferred to the California office for "faster processing". Any suggestions would be appreciated. I guess we will try sending in a letter, but I hate to get yet another RFE a few weeks later saying we still need a medical exam and an I-693! Thanks, Fred

  10. I will be making an appointment with my Immigration Attorney to complete LeiQin's immigration paperwork, if necessary. She has now shown me these documents for her and her son: I-797C Notice of Action papers that state the Dept of Homeland Security have received their I485 Application to Adjust to Permanent Resident Status. This was received on April 18, 2005. Notice type: Section: Asylee adjustment. Questions: Are her and her son now awaiting their green cards? What is the next step in the process? Now that she is residing with me, what is the best way to notify the USCIS about her address change?

  13. Ok I'm a little confused. I've completed all the forms for AOS except the I-693 which if I am reading it correctly means that Bing has to have another whole physical exam. If so what did I pay 100 bucks for in China? We have the Vacination records she got after visa approval, but don't they put all the medical records in the mysterious brown envelope? all we have is a little 3X5 booklet of her medical exam. Is this what we take to the civil surgeon along with X-rays?
