  1. Has anyone's SO been able to get a California drivers license before their AOS approval? California law does not allow someone to get a drivers license if their "legal presence" expires less than 60 days from the date they apply for their license. I don't know how the California DMV will treat someone who's AOS is pending, but not approved. Thanks for the info. I'm sure every state has different rules.
  2. I have a previous post about this, but the issue has evolved and I could use some advice from you guys. My wife, who came on a K-1, visa has been denied time and time again by Pennsylvania's department of motor vehicles for an ID. They state that her I-94 will expire within less than a month, and refuse to issue a four year ID or license. But here's the catch. The PA DMV has a document posted that indicates that she should be eligible for an ID. Click on the link below and scroll down to K-1. http://www.dot10.state.pa.us/pdotforms/fac...ts/pub195nc.pdf However, the DMV phone reps refuse to honor the stipulations of their own document... they gave me an excuse about some vague homeland security act. Then told me that I was confused. Anyway, I talked to a lawyer who suggested that I print everything out and bring it to the DMV... then get a letter from them stating why they can't honor their obligation. Here's where I need advice. Do you think it's worth it to take these idiots to court? And has anyone experienced such problems from their DMV?
  3. Hi, can anyone help me with a question that is specific to Pennsylvania? My fiance finally got her social security card, and we want to get a driver's license or id for her from the DMV. However, their bulletin states that Non- U.S. citizens need proof of residency in the form of tax records, lease agreements, morgage documents, w-2 forms, or utility bills. She just moved here, and we don't have these avaliable. Even if you are not from PA, does your state have similar requirements? If so, what form of proof did you show for the residency requirement?
  4. I applied for the AOS and EAD for my fiancee and her daughter prior to the 90 day expiration of her K1 visa. They each received 2 notices for biometrics. One for the EAD and the other for the AOS. Her drivers license is expired since in Florida they only allow the license for the expiration of the visa. Her biometric appt is in mid August but they will not even provide anything in writing to show this. What can I do? Also my stepdaughter is 7 and they even have a biometric appt for her. I am going to have her go however, my understanding is that this was not required.

  6. Wondering if anyone else has experienced this: Jade passed the written drivers test and got her learners permit today. Only problem is they told us it is only good until the I-94 expires which is March 3rd. They said she will not be able to get learners permit or license after that time until she is a legal resident (greencard in hand). Is this correct?? Doesnt make sense to me - if she gets her EAD how is she supposed to get to work?? Thanks, Jeff
  7. Today I spent most of the morning at one of the Ohio DMV's, just trying to get plates, and while there, I was asking this very nice lady about getting Lings Ohio State ID card. If some of you remember, awhile back I was having a problem with this, need this, need that, then need this. Today I was told that now all that she will need is her passport, the I-94, our marriage certificate, and get this, on their paper, her I 797. I did not even think that they knew about this. Ohhh, they also said for some more documention if I want to bring it, since I saw on the list, hospital bills, so I will bring this also. It does show. Whatever they want to please them, up to a point, I will get.
  8. Well, Minghao, my 18 year old step-son went with Jingwen and me to get his learner's license today. Two tests - 40 questions in all, 20 in Chinese. He was a bit cocky about it, having gotten a "practice test" from one of his buds at school to study. Total time in the testing room was about 10 minutes. He passed the road sign test but flunked the law test miserably (got 4 out of 20). He was incredulous. Jingwen said no problem. Let's give the official some money and get the license. I had to tell her that we don't do these things in America. She wasn't too happy about it, but she understood. Poor Minghao is still claiming that the test was rigged. He also claims the questions were the same as the practice test. So much for short cuts. The only downside in his learning the hard way about studying, is that we waited about 6 hours at the DMV to take the test. He'll try again next weekend. Maybe he'll study the old fashioned way, like reading the driver's manual.

Well today after getting bounced between 3 different people here at the local DMV, I was told to call the State office becuase they actually do not know. 1st person talked to, does she have passport and I-94, yes, then just bring in my birth certificate(I have no idea why), our marriage certificate. Okay, well we were married in China, hold please, now 2nd person, okay, you were married in China, then have you applied for SSN, no, have not because we have to wait for apporval for her work authorization permit, please hold, 3rd person, okay, have you received your 797c from back from INS. No, because we can not file AOS yet till we have approval from NSC regarding her I-130, which maybe another year, and about 6-8 months for SSN#. Ohh, then you have to call Columbus Driver Svcs, we really do not know. Now try and call them, they are harder to get through than DOS or NVC. All you get is a busy signal. I am goingo to hate when I finally get through, how long on wait. All of this just so that she can have a ID card with her photo so that she does not always have to carry her passport, so that she can also get a check cashing card from our local food store, just to use the ATM Debit Card, so that she can then show both. Just have to love this state.
  10. Hi, all! Read with interest Dave's experience with the Nevada DMV and had a follow-up question. My husband finally arrived two months ago and we married within a week of his arrival. We were in California and he had no problem obtaining a driver's license there (written and behind the wheel tests), but we recently moved to the Las Vegas area and tried to get a Nevada's driver's license. The lady at the Nevada DMV told us they cannot issue a driver's license for my husband because on his arrival card, it states the visa expires 3 months from date of arrival. We told them we are in the process of adjusting status and have submitted the application, but they wouldn't budge. Do you have suggestions or guidance about how we should go about getting acceptable proof of status? Thanks very much for your help!
