  1. Don't forget to add the document cover pages to the first page of any PDF sent to GUZ/NVC email address. You will have one for the I-864 and one for the DS-230. Any time you email the new documents, you must have a cover page as the first page. Also, when you send an email any cover page / documents must be in a single PDF.

    However, with regards to the checklist, I think things may have changed since you and your wife went through the process. The following comes directly from form OF-169:

    As soon as you have obtained all of the documents that apply to your case, read the statement at the bottom of this form, add your signature and date, and send the form to the consular office processing your case. You will not be scheduled for an appointment until you sign and return this checklist.

     

    So it seems that my previously mentioned issue of honesty is still at the table. Anyone have any input here? Should I wait until the end of June (once we're back from Hubei and have the police certificate in hand) before sending in DS-230?

     

    Thanks for your answers regarding the need for only one certificate. I hope that that's still the case, as we really don't want to have to go to Zhejiang.

     

    Any others out there have any advice for my fifth question above?

    You are actually only promising that you are aware of the requirement and how to satisfy the requirement in time for the interview. There is no need to wait until you have the police report in hand.

     

    Of course, taking it literally CAN set you back by a couple of months.

     

    Your choice.

     

    The domicile issue is separate from the financial support. Don't neglect either, but you can use your parent's house for your domicile. Shouldn't be a problem

     

    It may be a good idea to file your returns for all three years - 2009, 2008, and 2007 - if you owe $0, there is no late fee or penalty.

    Thanks for the confirmation on the police certificate, chilton747. That's really good news for us. We're still going to get one done here in Guangzhou, just in case. That goes for me, too.

     

    Randy, that's what I was thinking, as well. Just wanted to make sure. I'm going to send it off on Monday. I will definitely consider backfiling taxes; I'm well below the foreign-earned income cutoff, so I (hopefully) should have no penalties.

     

    Anyone have any additional thoughts on the domicile thing? Any experiences shared would be much appreciated.

    It will be interesting to see if you can get one from Guangzhou. The report from others who have tried is, don't waste your time and effort. All reports are sent back to the Hukou so they don't have anything to give you. They will simply tell you to go back to your hukou to get the report.

    I am currently working on my wife Xuemei's IR-1 visa application, and we received Packet 3 a week ago. I have a couple of questions that I hope someone can help me with, as it seems the deeper I dig into forums and websites looking for answers, the more confused I feel.

    1. My wife signs DS-230 Part I as the applicant, correct? I'm pretty sure, but I just want to confirm.
    2. Here's the big one. Xuemei lived in a total four places after turning 16: her hometown of Enshi (¶÷Ê©) for three years, Yichang (Ò˲ý) for six, Ningbo (Äþ²¨) for two, and now Guangzhou for nearly four years. I/we find the wording of the "Police Certificate" section on OF-169 (in both the Chinese and English sections) pretty vague. Do we need a certificate from each of those aforementioned places? I fear that we do (we're on a pretty tight schedule and are hoping for a "relatively" speedy process, if that's possible). Could someone point me to some straight talk on this issue?
    3. On form OF-169, should we tick the police certificate record box even though we don't have it ready yet? We're going to Hubei in two weeks, during which time we'll get it done in both Enshi and Yichang. (And if turns out that we need one from Zhejiang, then it looks like we'll have to go to Ningbo, as well). Basically, we want to cut down on any unnecessary wait time where ever possible, but I don't want to lie on any government forms, as that is essentially what we'd be doing if we checked that particular box.
    4. Is the $400 + $45 fee in addition to the $355 I already paid when filing the I-130?
    5. My final question, and perhaps the most difficult to answer, is this: does having a co-sponsor (my parents, in this case) who fills out the I-864 eliminate the whole problem of domicile, or just lessen the importance? We are planning on staying at my parents' residence for about a month or two before moving on to another city to live and work (my wife has a job offer already). The main reason I ask is because I have not filed US taxes since 2005 (I've been living and working in China since 2004). I'm hoping that that doesn't come back to haunt me; maybe I should consider back-filing?

    Okay, I realize that that's a long post and list of questions. I hope someone can help shed some light on these issues, because we really want to mail this thing off and get an interview date.

    1. Yes, your wife is the applicant.

     

    2. You will not be able to get a police report from any other source than her hukou. This one police report covers ALL OF CHINA, so don't worry. This is all you need.

    My wife lived in Shenzhen, Guangzhou and other places. She only got the police report from her hukou in Nanning.

     

    3. I would check that you have the police report. As long as you know you will have it by the interview.

     

    4. The $355 is the filing fee for the I-130. The $400 + 45 is the fee for the DS-230 and visa.

     

    5. There are others her who know a little more about taxes and domicile. We have had a few come back from living in China. I am sure they can enlighten you on what is necessary.

    I just discovered a problem on my I134 form. The expiration date is May 31st while my interview date is on 1st June. I went to the USCIS site to download the official version and it's the same expiration date. I searched everywhere online, same expiration date.

     

    I dont understand, how is it possible that there is no new version available as people are having interviews later than May!

     

    Or, should I understand it differently, as long as the signature of my fianc¨¦ is before 31st May, then the document is valid ?????

     

    I am getting so nervous all of a sudden as I dont have much time left ...

     

    If any one has a newer version, please kindly send it to me.

    This should not be a problem. If you notice on the forms page under edition, not only is this form acceptable, but all previous forms (which have been expired as well) are accepted. This means even though the form is updated to reflect the new expiration date, it really does not change. So they will accept new and expired forms.

    Domestic homicide

     

    It can be very horrific. My favorite cousin was in the process of leaving her abusive husband. She left and was living with her parents. Her husband caught them in the driveway one day when they were leaving. He shot by her and then himself. Right in front of their children!!! Imagine having to live with something like that the rest of your life.This kind of thing happens all too often. When things aren't right, it is time to leave. However, don't just leave. You must disappear or the violent spouse will will track you down. This is why women shelters are very secretive about their whereabouts.

    He (she) is legally in the US as a Permanent Resident. Why should she need more than: Valid driver's license, registration, and proof of insurance?

     

    Because the documents you mention are not acceptable proof of immigrant status. You can get these documents while your status is legal, but still have them after your status changes. Example, you are here on a two year green card and while your status is legal, you acquire an Oregon drivers license. ODL's are vaild for 8 years. Now you file for removal of conditions, but are denied. So you are no longer legal, but you still have your valid ODL.

     

    The only document which shows proof of your immigrant status is your I-551 card or green card. So, yes technically you must carry this card with you at all times.

  10. I just paid the $400.00 for my wife and daughter. On the NVC web site the status has changed to "PAID".

    On the "Immigrant Visa Application Processing Fee Bill Invoice" and the "AOS, and IV Fee payment Receipt Details" , it states that I need to print a copy of the "Document Cover Sheet" for each fee paid.

    What are they asking me to do? What is the Doc Cover Sheet?

     

    Got to tell everyone that the Elect processing process is going faster that I thought it would. Pleased so far!!!!

    Once your case has changed to paid, it should open two new links to the document cover pages. There will be a document cover page for the I-864 and one for the DS-230. The cover pages will have the case number in bar code. These pages must accompany the appropriate documents so they will be attached to your case.

    Very nice doctor, he did it as a service - no charge, while I waited.

     

    The first time I called, his receptionist wasn't familiar with the procedure, so she quoted me full medical. I asked her to consulate with the doctor. She came back and said, he knew exactly what was needed.

     

    Others in the area wanted of course to do the full medical and would not budge.

    Not needed as my wife was here on a K1 visa.

    This doctor gets six out of five star service from me.

     

    Just a note, this was all done in 2005.

     

    Also, it isn't so much that Civil Surgeons are cheaters. They are just very unfamiliar with family visas. They are afraid of losing their CS status if they only do a partial I-693. Also, when the doctor is familiar with the rules, the office staff who generally start out with has no clue.

    So yes, it is possible. She will have to work extra hard, but after watching my wife, our gals are nothing short of amazing.

     

    Get her high school diploma from China. Then have it translated by a professional organization here in the US. My wife's school had it done as a service to her.

     

    She can take what is considered Intensive ESL classes. These are usually much more expensive than the community college. The community college only works toward the student making it in every day life in the US. The Intensive ESL classes are designed to help the foreign student pass the English entrance exams for college. My wife took two months worth and it was well worth the additional cost.

     

    She can also opt to take vocational training. College entrance exams may or may not be necessary depending on the schools requirements. One massage school wanted my wife to pass the college entrance exam, another school did not. The second school was selected not only for that reason, but they seemed to be more carrying about their students.

     

    Don't worry it is absolutely possible.

  13. My lawyer told use we should wear profesional clothing for our interview. Can I see some examples of some of the outfits you all wore to the interview.

     

    This will have absolutely no bearing on the outcome of the interview. My wife is from a farming family. She wore jeans and a nice shirt. Duration of interview - 2 minutes. Passed with flying colors.

    They don't care very much how you are dressed. They care more about how your case looks and if you have a bonafide relationship.

    Ever since I can remember, there have been more hookers and strip clubs per square mile in Hainan than anywhere else in China -- even including Jilin Province.

    I think this depends on what kind of look you want, for how long and how much attention you want from her the rest of the night..

  15. Life has changed a lot. First she is going to English classes now and that will help. Fengjie took the dog for a walk one day and got lost on the way back. She loves hot water and orange juice and tea. Pretty much is what she drinks. She has made Chinese food and likes doing that. Sometimes I have no clue what she is telling me. We have a hand held abd we use that. But sometimes that doesn't work. Then it is plan B. I called Yan and she told me what she wanted. She likes going to Golden Corral. She has a choice of what she would like to eat.

    Fengjie's call China a lot and I did show her how to do with the help of Yan. We also have used Yahoo Messenger and QQ. She does have her own cell phone. So this does help. Everyday there is a new adventure. I have to work at the ball park sometime and she bag the popcorn for me. She also helped with the hot dogs.

    Not understanding English has been a little tough for her. But it will get better as time moves on with her classes on English. There is never a dull moment.

    Still learning what American food she likes. Plus I made a roast and potatoes and carrots in a crock pot. She really seemed to like that. Of course we do go to Chinese places also. Since my friend owns one. Turns out that has been really good. There is a woman Mae that has a daughter that goes to school in America. She has a DVD and other items that she can use to learn English.

    We have a long ways to go. And looking forward to a bright future.

    Great Update, Michael. One thing I found that helps my wife learn English. I talk to her just like any other person in America. Then we concentrate on the translation, This way she learns how English sounds and get used to hear it. She also asks me to correct her grammar. This way she does not get used to bad English habits. Yeah, you have a long way to go, but it will be a great trip. Enjoy.

     

    If she is constantly talking to family and friends in China, you might consider replacing your home phone with Italkbb. It is a VoIp service just like Vonage, except you get free calling to and from China. I have had it for four years and love it.

    My experience was that it did not matter which email the scanned PDF's came from. When my wife petitioned for her parents, all scanned documents were sent from the Petitioner's email address. We had no issues at all.

  17. But wife tells me that it must be much more serious than simply owing child support. Generally, she says, when the passport shows up as revoked they are told to cancel passport and return it to bearer. This time the instructions were to retain passport and forward to Department via legal attache. That generally means there are also some fairly serious warrants outstanding and they're retaining the passport as evidence or as part of an ongoing investigation.

    Yes, this depends very much on reason for revocation. You don't see much information on Bejing Embassy web site. Just how to apply. However, I have found information on another Embassy's web site that shows all it takes is an arrears child support for them to retain your passport.

    A: Yes, until the applicant resolves the child support issues and we are notified of that by the Department of Health and Human Services. See 7 FAM 1387.

    It states a section of the manual, so this is SOP for all embassies. So no. You won't be seeing him in the news. It is probably nothing more than owing child support.

  18. The key here is intent. What they are looking for is the intent to evade immigration policies. Couples whose primary intent was to fraudulent use the immigration process will go their separate ways and avoid mixing finances. The best thing you can do to show your intent is placing her on the title to everything you own, house, car, etc.. and intermingling your finances completely. Put her on all bills coming to the house, all of your bank account and credit cards. Do not even bring up the temporary residence unless they ask. If you show proof of everything co-owned and all of your finances intermingled, they most likely won't ask.

    Nutrients... American doctors advise against letting babies under six months old drink water. The reason is that a newborn needs an incredible amount of nourishment for their growth during this period. A babies stomach is very small so giving a baby water deprives them of much needed nutrients and can inhibit their normal growth. You don't need to feed a baby water for them to get water, They will get all the water they need from breast-milk or formula. You can start a child on water once they reach six months old.

  20. I got the two AOS processing fee bill invoice packets (one for my wife and one for her daughter) in the mail. I paid the fee, $70.00 on-line. I want to OPTIN for the electric process for GUZ. Checking the case status on the NVC web site still showes that the fee in still "In Progress". I paid the fee on March 29th. so I think I need to still wait a few more days for the fee to process.

    Question:

    By paying on-line did I cause a time problem with the OPTIN process?

    No you did not cause a problem. You did just fine. Actually, better than fine. If you want to opt in, they warn never to mail anything to NVC as it will cause a big delay. So this means to opt in, you must pay the fee online. Don't worry it takes 3-4 days for status to change. I did electronic processing for my wife's parents. Paid the fee on-line, then in 3-4 days the status changed and I was able to continue on.

  21. Just Curious about the reliability of the USCIS website. I can logon and see when our file was last updated, or "touched" I believe the term is. But once a decision is made, how many actually see this changed? or it is just all of a sudden you get an email, or a letter in the mail? Just Curious because of what I was recently told by USCIS.

    It varies greatly, some times you see touches throughout the process other times only at major events like biometrics, and then a day before decision, then email.

     

     

     

    Other times you get absolutely nothing updated. The cases for my wife's parents show they are in the initial review stages. Except, they have really been approved and sent to NVC since they have been here since November.

    So Robert, what did you decide on the big wedding plans? Is a trip to Vegas in the cards. Maybe you can just roll into town, but don't crap out before the big shin dig.

     

    I will give you the same advise I gave Michael. "Sometimes the adjustment can be hard. Remember, she left everything behind to start this new life with you. She is taking a big leap of faith. My best advise is do not work on making her happy. You will fail miserably. Instead, just be as supportive as possible. Be there in any way and at any time she needs you. Do not tell her you love her. This means nothing to a Chinese woman as to them it is just words. You will be miles ahead just to show her how much you love her. Then the occasional "I Love You" has so much more meaning."
