  1. So I researched something similar earlier, but people said you have to meet in person to consummate the marriage. Here's a quote from a lawyer's blog post on the issue that can also be found here: https://lawandborder.com/is-a-utah-marriage-over-zoom-valid-for-immigration-purposes/ It would have been great to apply for a marriage visa instead of a K1, but at this point, when the K1 is almost completed. I can't just throw it away. I'll just find another way for her to get here by getting vaccinated somewhere I guess.
  2. Can my fiance's father get a passport to come see our wedding? Is family reunion a valid purpose? Especially considering she hasn't left yet.
  3. I called a bunch of hospitals and doctors that deal with foreigners in China. Apparently, COVID-19 vaccines widely available in China are not commercially available vaccines, but are provided for free by the Chinese government for it's citizens. So to get the vaccine, you must follow the government policies and she's not eligible to be vaccinated again for six months. So unless anyone can suggest a private source of who approved covid vaccine in china, the best approach seems impossible as going to another country will require long duration quarantine in both directions and she'll loss of employment for her. I think I'm the first person to post this issue, but it will impact more and more people as the rules come into effect.
  4. https://www.cdc.gov/immigrantrefugeehealth/panel-physicians/covid-19-technical-instructions.html China doesn't qualify per cdc, link here: https://www.cdc.gov/quarantine/order-safe-travel/technical-instructions.html#anchor_1635183102468 According to the press call transcript attached to the proclamation, the CDC was expected to use the world health organization's country vaccination tracker, and China's at about 68.97% fully vaccinated, which is higher than the USA (62% fully vaccinated). So that clause is not going to work. I researched the I-693. The CDC technical instructions for medical examinations say, quoted below, but direct link click here So she must complete covid vaccination with an approved vaccine before the medical exam? This is a bigger problem than I originally thought?
  5. Biden's new travel proclamation requires a world health organization approved vaccine, but my fiance received a biokangtai chinese vaccine that is not approved before the proclamation was issued. Now we called around a few community vaccination centers and they won't give her another vaccination, because she's considered fully vaccinated in China Any thoughts on how to solve this issue?
  6. Thanks! Honestly, we started researching this, because of the new CDC dog import requirements. They labelled China as a high risk country for rabies, and will only issue an exception permit for lawful residents and US Citizens relocating permanently back home. It appears that my girlfriend cannot apply for a permit as a K1 visa holder is not a lawful resident, and I'm not relocating to the USA, so I can't take the dog back. Maybe we could apply after she got her LPR? It would also be great to get to live with each other sooner and start our lives together If we take the dog to Canada and live there for six months, the dog is no longer considered as coming from a high risk country according to CDC rules.
  7. Is it possible or a bad idea to move to Canada during the K1 process? We submitted a few month ago and I'm awaiting the NOA2, but it's difficult not being able to see each other with all the travel restrictions. If she got a student visa to study English in Canada, and I got a NAFTA Professionals visa, could we live together in Canada and would they move the interview location to Canada as counting on being able to travel back and forth to China during this time is a little bit tenuous. Are there any pro/cons to this approach if it is possible.
  8. I read that you can get a proxy marriage in Kansas, and one party just must be present in Kansas for 3 days before they are eligible. I live in the midwest, so Kansas is not so far. I also read however, that for a marriage to be valid for immigration purposes that it has to be consummated. Which I guess is something they are not going to ask you in an interview, but if you cannot show that you've been together after the marriage, they can assume is not actually the case. Here's a quote from an attorney's website, "US Immigration requires eligibility at time of filing. Thus, a proxy marriage must wait for consummation to occur prior to filing an I-130 Petition." I guess "cybering" isn't good enough. https://www.fickeymartinezlaw.com/immigration/proxy-marriage-and-us-immigration-clarification-on-the-consummation-requirement/ But is the CR1 timeline similar, where they will process most of the CR1, and then wait until the 2 years is up, and then have the interview, and then do a CCP investigation for 5-7 months, and then issue the visa? (assuming everything goes well)
  9. Okay, thanks. One additional question. Since I have to wait a year at this point for the J-1 Home Rule Residency to expire. Should we get married now and just apply for the CR-1 and wait for the 2 year J1 home residency requirement to expire?
  10. Wow thanks. I didn't realize there was a two year prior meeting requirement. Normally, I wouldn't think that would apply to me, but given the current unknowns. It could easily be another year before I see her, although I sincerely hope not. I better get to filing. So you think that applying for the K1, 1 year before it will be allowed is okay? There's another thread where they say to move it closer to the 2 year expiration. Thanks for the link on CCP membership issues. I actually realized when applying tags to my post the tag search system. I had trouble searching before that, because j1 and f1 were two characters. I found this post regarding CCP membership and citizenship, where the OP could not get citizenship for 10 years and also didn't have evidence of leaving: I wanted to suggest you add something about the 10 year since left requirement for citizenship to the CCP Membership issues page, because I wasn't aware that this would likely extend her citizenship, and that it would be a good idea to try to save some sort of record of her leaving in case we needed to prove it for citizenship purposes. I found that info to be supervaluable.
  11. A year ago, my visiting scholar g/f went back home and I was supposed to meet her 2 weeks later in Shanghai, but travel has been banned and I haven't seen her in a year. We talk every day on Wechat and Skype. She was a J1 visitor with 2 year home rule residency requirement. She also has CCP party membership, but just a university teacher in a liberal arts subject, not involved with the government or military, and if she quits CCP she loses her job. We've decided we want to be together forever. I was told I could apply for the K1 today, and they would process starting now. If they finish before the 2 year requirement is met they will wait for it to be met and then issue the visa, so I don't have to wait for it to be met and then apply and wait for the K1 to process. We're worried about the CCP membership with everything Trump said about it. Should we wait for Biden to be in office for a while to apply, or should we apply immediately hoping that we will get it soon after the 2 years expire?
  12. No stamp. Only previous entry stamp. I think Customs had her switch lines to the automated passport control ESTA line and then somehow after she entered her information on the computer, she went through the officer didn't actually see her and stamp or verify the information Didn't realize what happened until this moment.
  13. How long does it take for an I94 to be issued? My friend entered the US in February, and then entered the US again a week ago. We logged into the online I94 system. Her most recent entry isn't listed on the I94 site. Instead, her previous entry from February is listed with an expiration of 8/18/2017 (six months from February) and it shows her leaving in March. Does ICE generally reuse the previous I94 or is this an error?
  14. Hey, I just wanted to mention that my girlfriend and I use Google's Project Fi cell phone service to communicate and it works really well for us so I wanted to recommend it to other people in similar situations. 1. $10 per gb LTE data service in China and all over the world, American phones don't need a vpn service to get access to facebook, gmail ,etc.. Pay only for the data that you use. My friends who went on the trip with T-mobile only got slower speeds, but fi gives you full LTE! 2. $0.01 per minute phone calls to china. You can make calls from the USA to a Chinese phone number for a penny per minute. This is great and no calling card is needed! The only downside is: 1. 0.20 per minute phone calls from the sim when in China, better off using a local sim for voice when you are there. 2. Supposed to use their phones. You can actually put the sim in other phones and it will work, but you need to activate it in one of their phones to start and only a few phones work.
  15. So once we get married, I doubt we would maintain a $1,300 a month apartment in Beijing if we aren't living there. There won't be a Chinese address by the time the petition is approved unless we use her parent's address in the countryside I guess. My point was more that the petitioner is me, because I"m the US citizen and if I can't claim that I'm living in China, then I can't file in China. I would need my residence to be where I file. But you're saying that even if I file somewhere else, she can still interview wherever she is.
