  1. So our interview is in less than a week and I am worried about proving domicile.

    What we have right now is the following:

    Bank statements showing bills being paid and american credit cards being used

    Bank statements showing wire transfers from China to American bank account

    We are both un-empolyed while living in China...?

    Emails asking to lease a business in America



    We obviously cant rent an apartment in america yet because we are both currently jobless. Though I'm worried what we have might not be enough..

  2. Ok so do I send these with the packet or save them for the interview?

    Save for interview, the I-864 along with other required docs like police cert, birth cert etc... are turned into the consulate the day before the interview.

     

    Only thing from packet 3 that gets mailed to the consulate will be OF-169 and DS-230, packet 3 contains an I-864 for you to prepare for interview, and the instructions with Packet 3 tells you whet to mail to them.

    So you just send the OF-169 with the boxes checked and signed, the ds-230, a cpoy of his passport's bio page, and the mailing label?

     

    Am I understanding that correctly?

  3. I haven't worked abroad so this shouldn't be a problem..?

     

    Another question i have, so when I fill out my I-864 and my mother fills one out as well (she will be my sponsor), do we send them along with the rest of the packet? or do we save them until interview time. (we are preparing everything now since we just got the go ahead to send everything)

    If was abroad for schooling, just note this or not working and how was supported.

     

    As for I-864, no your parent is not sponsoring you, you are not the immigrant. Your parent will be joint sponsor of your spouse who is immigrating.

     

    You will be primary sponsor, parent will be joint sponsor.

     

    Since you are not living at home and not claimed on parent's return, your parent will not be counting you as a dependent either.

  4. Just some general notes that probably don't apply to you, since you're below the minimum.

     

    The minimum to file for a single taxpayer is the amount of a personal exemption plus the standard deduction for one person. For 2011, this is $3700 exemption, plus $5800 deduction or $9500. This minimum ONLY applies if you are NOT listed as a dependent on another return (your parents?).

     

    If you DO NOT file, you cannot claim the foreign earned income exclusion. If you earned ABOVE this amount, you may be required to file, even if you owe $0 tax, in order to claim the exclusion.

     

    I haven't worked abroad so this shouldn't be a problem..?

  5. A student without income can be explained, however a person who works part time still files a return.

     

    If income was below a certain amount (Around ~ $9750) then you need to explain this amount and that a return was not needed because of this.

    The times I worked part time were always short times (the longest being 9 months) and so i never made over 6k a year, thus I never filed. So with that said is writing a letter explaining my lack of tax records all I need to do?

  6. so I havent made enough money in the past 3 years to have to file taxes (been a student or just working part time) so my mother is going to be co-sponsoring.
    My lawyer suggested that I write a letter stating why I havent filed taxes and to have it notarized by someone at the US embassy, which to be honest im not even sure how to do.

    Any other advice for someone with no taxes?

  7. ok so I had emailed guangzhou about this matter.. about a little less than 2 weeks ago and they replied back saying they had updated their records regarding this information. So i had put it out of my brain UNTIL I got this email today..

     

    "Please note that we have received your petition from USCIS in Guangzhou office, however, we failed to continue with this petition since Mr. ****¡¯s mailing address in file is not in Chinese characters. Furthermore, Mr. ****'s phone number 0871-69081175 recorded in file is also invalid. Could you provide us with Mr. ****¡¯s mailing address in Chinese characters, along with postal code and contact phone number? Please send this information through web form at http://guangzhou.usembassy-china.org.cn/immigrant-visa-unit-question.html"

     

     

    I'm really freaking out now T.T what will this do to our petition? Does it get tossed aside? This obviously screws up our wait time right?

     

    But hey at least we have a case number now <_<

  8. Alright awesome :D Also.. another thing i dont quite understand. Something that else that has kinda been buggin' me is she asked me for my chinese address in CHINESE (because I had written it in english because I dont write or speak chinese) what i dont understand is why she could possibly need this.. considering I was told that chinese citizens who work for the government are suppose to have no involvement in case handling.. and seeing as any american working in guangzhou would speak and read my chinese address in english just fine. Idk maybe I'm being paranoid but after a bad incident I had at chengdu which resulted in me contacted my senator and him being very upset by what was going on there (long story) I was told to be cautious of things..

    Some Chinese citizens are in fact involved, the Chinese POST OFFICE needs a Chinese address so that they can deliver the approval notice, Packet 3 and Packet 4 to your address in China.

     

    For example the US Consulate address in Guangzhou is:

    Forgive me if I'm a bit naive in this.. I send all my mail to the US in english as does my husband so I wasnt aware that they NEEDED it, I just figured at best it was just more convenient that way. I just wish they would have asked for it that way on the form so I could have had my husband fill it out that way. Since they wont let him come with me or let me ask him via cell phone

    Nope, normally the notify by mail. The phone number is used sometimes to confirm mailing address.
