    Do any of our VJ co-members know of ANY K-3's in recent years? I have no clue as to how you would get it past NVC, if so.

     

    Earlier this year, one member from Canada had a K3 make it all the way to the Consulate (the I-129F became separated from the I-130 and made it to the NVC first); however, once the IV unit in Montreal got wind of an approved I-130 on-station at the NVC (it did eventually catch up), the IV unit at the Consulate closed the K3 and told the person to follow the steps for the CR-1.

     

     

    Where did these statistics, showing 12 K-3's that went all the way to interview (and apparently approval) come from?

  3. Today by accident, I discovered this form exists :bangin: . When we moved at the end of April, I did all the proper updating of items (including the AR-11) but was completely clueless about this form. I'll file it this week but I'm probably looking at some kind of fine.

  4. Well, that distinguishes this from the black hole back in 2002-2003 in that action IS being taken. Hopefully, it'll have a positive effect on processing times, but the confusion factor of giving work (I-130 processing) to centers that aren't used to performing that work is not a good sign. The net effect remains to be seen, as well as what else may be impacted.

    From some of the discussions on VJ, field offices are using dated field manuals; for example, field offices are issuing RFE's for the birth certificate of the beneficiary.

     

    The field office in Atlanta has become a black hole if a file was unfortunate enough to end up there, someone posted that they were told that none of the I-130's that were sent there starting in August have been looked at.

    Wouldn't that mean that they're being called in for an interview? This has happened VERY occasionally in the past, usually only for a felon, or some other major flag.

     

    Nope, this has been happening since August and it's not because the petitioner is being called for an interview or any other major red flag. I-130's have been routed from the lockbox to the National Benefits Center in Missouri and they either stay there or they are sent to a local office for adjudication. As I previously referenced, there are many discussions on VJ about this.

    Just to clarify, the temporary green card is a combination of the visa itself and a standard entry stamp placed on the page next to the visa by CBP. CBP will write in the A# and expiration date on the entry stamp fields; this is the "endorsement" that is referenced on the notation that appears at the bottom of the visa.

  7. One more note, consider marriage on your next visit or the one after that since you have all these trips already planned, and then file for a spouse visa.

     

    Spouse visa has no adjustment of status after marriage and the added expense and sometimes long wait for a green-card like a K-1, a spouse visa gets green-card the moment they enter the USA.

     

    One factor is potential step child visa, if step child will be age 18 or older at time of marriage, then the K-1/K-2 is the only option.

    • I-130 $420 each
    • DS-230 $230 Each
    • I-864 $88
    • Total $738 each.
    • Grand Total $1476.

     

    Tack on $165 each starting early next year. This comes into play after the visa has been issued but before the flight to the States. It's a fee USCIS is levying for processing the file that is handed over at the POE which results in the green card being sent out.

  8. I plan to marry in China. I have my Passport, Michigan Birth record, and Michigan No Marriage document. I will need these documents to marry in China. I think that I still need to send the documents to the China Consulate in Chicago. The China Consulate can do the authentication of the documents. I think that the documents will need to be translated from English to Chinese. Do you know when or where I can get the translations?

    You don't need your birth record from Michigan. As Randy has already stated, you won't need translations for the authentication process. The only thing that will ultimately need to be translated is your statement of single status. The marriage bureau in China will direct you to a translation office of their choosing.

    I agree with this. When I went to Guangzhou for my wife's interview last year, I think it probably did me more good by the fact that I was simply there. I'll say this though, the wait from the time your loved one goes in to the time they come out can be excruciatingly long but will no matter when they give you the good news.

    What exactly you mean by long form? You mean they had a problem with you using the I-864EZ, and demanded that you use the I-864? If that is the case, sounds like typical GUZ document intake people, it seems they are not familiar with the I-864EZ and demand the I-864, which is incorrect.

     

    I-864EZ can be used when (Only sponsoring one immigrant, not using assets, AND not using a joint sponsor). AS NOTED on DOS website: http://travel.state..../info_3197.html

     

    Probably good for others to know this, and limit use of I-864EZ to AOS from K-1 or other non-immigrant visa in the USA.

     

    I used the I-864EZ and it was accepted with no issues. I had my wife submit a revised one when she went for document intake (I got a raise between the time I submitted the first I-864EZ to the NVC via email and the time her interview took place); document intake personnel accepted the revised EZ form and did not give us any trouble.

  11. Update! I received the NOA 2, notice of approval, in my mailbox yesterday August 22. The notice says the petition is approved but will now be sent to the NH NVC for further processing. General vague timelines were given in the notice. So we have hurdled step 2 and wait for the NVC to get our petition and do their thing and send it to step 3.

I feel like a battle-worn warrior who has returned for one last mission with the immigration system. It just has to be easier this time around! Doesn't it?

     

    Judging by the timeline in your signature, you started the K1 process. For K1 cases, the NVC is nothing more than a mail stop, a case number is assigned and the file is sent off to the Consulate.
