Lee, first congratulation. I want to ask: why did you file an I-90? since he was your son, could he just ave been getting a passport like that? Also in the new child act, do we still have to notify the USCIS to forget the child as they became us citizen ?

remove condition on a 2 year GC for K2
jean-charles replied to jean-charles's topic in AOS & Immigration Challenges
So how do you fill up the form? the child is not a spouse not a battered child, ... what's the option to check? and does the sponsor have to sign that one as well ? or can the mother sign that one? I've just been through the same thing. Wifey got her gc in May of 05 but her daughter had to wait 6 months for a name check. I called USCIS/BS to ask-cuzz if they file together there is only one fee and if they file seperate there are two fees. Normally when a k1-k2 files for the 10 year card they do so with one application. BUT, you can not file until it is 90 days or less to the expiration of the GC and you CAN NOT file after the expiration date. If K1 and K2 had expiration dates on the GC that were 89 days or less apart-you can do it. If not they must file seperately. This is all according to USCIS-I called 3 times and talked to several people-all said the same. So, in our case, although wife and stepdaughters interview was on the same day and both approved, USCIS dropped the ball and forgot to order the stepdaughters name check-thus we waited 6 months for her GC and have to pay the fee twice! Damn, I'm gettin' pissed again!!! -
hi, friend of mine came as a K1 then her son came 6 month after. Her GC expire in march 07, her son's GC expire in july 07. When she filed her removal of condition she included her son on the papers, ... however she is wondering if she need to file a removal of condition for her son as well or is hers joint with her son's ?

Can we go out of country on honey moon?
jean-charles replied to jean-charles's topic in AOS & Immigration Challenges
Her visa is for entry into the USA, one time. Without advanced parole, your fiance cannot leave the USA and enter again. Even with advanced parole, she will need whatever any other Chinese Citizen would need in order visit another country. Her US visa doesn't change anything with any other country. May I suggest the Florida Keys or Hawaii. that's what I thought so until the AOS is complete and she has a temp green card she can't leave the US (I am only looking at the USA side for now but good point on the visa for other countries, ..) Problem with the keys is that cruiselines all stop in cosumel or mexico, ... and you need a visa, .... Hawaii is on my list but darn far and expensive, .... Maybe just renting an hotel in the keys and simply fly miami and rent a car, .... any one know on good last minute deal web sites ? -
Hi, my fiancee is arriving within the next 2 month in the US on a K1 visa. for ease of the process we are getting married at the city counter, the most simple way then we wan tot go on our honney moon somewhere, ... carreabeens, mexico, ... so here is my question, by the time we leave on a last minute deal on a cruise somewhere she will have her chinese passport, maybe temp work permit given at the border and barely an AOS filed if we have had time so can I book a cruise or resort in mexico, puerto rico, ... bahamas, ... ??? with her visa status then ?

Hi USCONGUZ, First thank you for helping us in clarifying things here, you are a big help. I wanted to ask a similar question and did a search and found this topic so I think it will be better to add to it. When this question was previously asked it was August 2006. Now in January 2007 it seems that the waiting process for an appointment is now about 3 Month and that when applicants call they even are sometime told that there are no more appointment available all together. This raises the following question: - Is it possible to retain an attorney in GUZ after receiving a blue slip and thus ask him to deliver the requested evidences? - Can this attorney then in turn receives the Visa for the applicant? - Can this attorney be anyone with a standard DHS power of attorney? Thanks for your help

This is very interesting and seems reasonable enough. I think if a person is clean and has no arrests, they have nothing to fear. I'm a little concerned about Question 19. I know some of these so called marriage/dating sites have probably complied with the law, however, what if they are not in compliance yet? The USC has no control over that end of it. It only asks for the name and address of the site. I know these are new questions; they are the first ones that popped in my mind. 220817[/snapback] so if you meet on a website like match or asiafriendfinder, .... this is considered a mariage broker? I mean they didn't make any arangement or broker stuff, you pay to chat , you find that you like each other, ... then off the site, ... do we must put the name of the site in that case? it's not really a brokerage service

Hi, I filed a I-129F with a filing date of April 3rd 2006 and filed at the Nebrasca service center and just now I got a notice as follow: On June 1, 2006, we transferred your I129F PETITION FOR FIANCE(E) to an office in CALIFORNIA SERVICE CENTER for processing. That office has jurisdiction over the case. They will send you a written decision as soon as processing is complete. You should receive a notice informing you that your case has been transferred to a local office. so WTF, I am from MN, why are they sending them there so I called, .. type 3, 4 8, if you have long harms, press 23, ... and got a hold of someone. There the lady tells me that this is new and all the cases of a certain type will now go to only one center. So I guess this is their solution to the new law IMBRA stuff where california will process ?!?!?! what do you guys know ?
