  1. You should be better off than I was. I only went once due to work restrictions and financial difficulties. I got married on the first trip because of presure being put on us by her parents. They wanted her married before she became an "old maid" and told me that if we wern't married by a certain date they were going to arrange a marriage for her. So I came, met her family and we got married. We knew each other for about a year before that unfortunitily there comes my next red flag which was that we were married very soon after my divorce. Again the reason for this was the pressure from her parents. My first wife was deported because she was accidently infected with HIV but we couldn't prove it. My first wife and I knew that she was leaving for awhile and she encouraged me to meet someone else and I met my curren't wife. I am not sure which of these flags caused the denial but I suspect it was the length of time between visits. Both USCIS and NVC had my divorce papers and knew that the divorce and marriage was close together so they shouldn't have been able to issue a denial based on that. I am hoping to get help from Marc Ellis but I have also talked to Peter Pagnet. I am hopefully taking an emergency trip to China to try and keep my case from being sent back to the US. The NVC said they need to consider any additonal evidence as long as they have the file. Hopefully I will get this resolved although it might take some shouting. JBHypno
  2. The first lawer I spoke to said there was a chance but I would need to go back ASAP. I also emailed Marc Ellis and he seemed optimistic but hasn't replied to my email with the additional information he wanted. Based on Roth's memorandum we had several red flags but she wans't given any oportunity to overcome. The woman who interviewed her never even looked at the additional evidence she had with her. It was like as soon as she said I had been there once it was over. I am in a very demanding job in a bad enconomy and couldn't afford to keep visiting. We talk everyday on webcam and have a very stong relationship. She helped me get thru my divorce and even though I am in this for the long haul I think her family may start putting pressure on her since they want her to start a family. I am prepared to go to China this week, even though I don't have all the money I would have had if I could have waited until June like I planned to. I just need to know if there is any chance of getting this resolved without waiting for 2 years. I-130s don't expire so I don't think I have the option of reapplying. Tell me this GUZ would a woman who was commiting fraud run off to temple to pray for answers on why she was treated like this if she didn't love me and want to be with me. We love each other and want to be together but I am not rich and can't afford to make too many trips and my company won't give me alot of extended vacations anyway. Anyone know the best phone number to contact Marc Ellis at? I can't keep playing email tag I don't have the time before this gets kicked back to the US. JBHypno

  4. Well I am starting to get hopefull. It is looking like since my wife was never given a blue I might be able to overcome the denial and keep the application in Guangzhou. I have already talked to one lawyer in GUZ and am now talking with Marc Ellis. I will let you know what they say. I am also trying to arrange to go back to China sooner than planned. If I want to fight this I need to go back within 30 days. JBHypno
  5. Ok my wife got the white on Tuesday. She wasn't given a reason except for the bonafied relationship excuse. Based on the first question I think that she was denied because it was over a year since I was in China. Mostly due to work and money issues. She had a letter from me that explained the situation plus a letter from the bank showing we had an account together but I don't think she really looked at them. I spoke with a lawyer in GUZ, Peter Paget, who said I had a slight chance of keeping the application in China if I came within 30 days. I was planning on going in June. Assuming that I can pull the money together and get the time off does it make sense for me to try to keep the application in GUZ or should I let it be kicked back to the US? If I let it be kicked back how long is it currently taking to get the letter and to process appeals? I am CR-1 now but will hit my 2 year anniversery in June. I was forced to be apart from her for almost 2 years and don't want to wait another 2 years to bring her here to the US. JBHypno
  6. As far as I know the application is automatically kicked back to immigration. The embassy will only give me canned responses. I will do a search to see if there is anyway to keep it there but I doubt it. JBHypno
  7. WHITE!!!!!!!!!!!!!!!!! 4 questions took my letter and the photos of us together and gave her the white slip insufficient proof of bonified relationship. Now I've got to go thru the appeals processes. WHO IS THIS WOMAN TO SAY WE DON'T HAVE A REAL MARRIAGE Now I've got to pay even more fees take even more trips, which I can't afford, and I could still get the same officer on the next interview and she could still say no for some undisclosed reason. I am going to go visit Feng for our aniversery and be there for the next interview and I swear if she gets denied again I am going to go postal on that interviewer.
  8. It's the same with me. Can't go to interview. I am planning on going around June 5th to be there for our 2 year aniversery.
  9. We are CR-1 now but we are close to IR-1. Interview is at end of April and our 2 year aniversery is in June. I am not sure if we wait until after the aniversery for her to enter if she will automatically get her 10 year or if it is based on when she is interviewed. I guess we will see in a few months.   11. Just called and my wife got April 28th. The long wait is nearly over!!!!!!!!!!!
  12. DHL tracking shows that my package has cleared customs but the DOS still shows that it hasn't arrived yet. To make matters worse I can't call Guangzhou to ask them directly because the fee payment system doesn't work for my mastercard. When I try and use it it looks like it tries to do Verified by Visa for it which fails since it is a Mastercard. Is there anyone else here who was in the Oct. 27th shippment that got a different answer from DOS?
  13. DHL shows my paperwork was released from customs today. Finally some action. JBHypno
  14. I just called DOS they are still blaiming it on customs and all they can say is 4 to 6 months from NVC complete. The woman that I spoke to says that is all the information they have and they can't speak for claims made by DHL that the paperwork is sitting in a warehouse. It looks like any action is going to have to be done from the Guangzhou side. Anyone want to pay a fee to ask the embassy what is going on? JBHypno
