  1. It is time to prepare my stepdaughter's 751 application. My wife has already received her 10 year green card, but we had to wait awhile to apply for her daughter since she arrived here 11 months after her mom. So, my question is this: On page 2, part 4 of the 751, who should we list in that box, her mother, or myself?

  2. It's finally time to apply for my wife's lifting of conditions. She came here on a k1 and her daughter on a k2 about 1 year after her mother. So, my question is whether or not to list her daughter on part 5 on page 2 of the 751. I realize that her daughter is not eligible to file at this time hence my question. Thanks for any help on this.

  3. I sympathise with your plight but I hope this serves as a lesson to those going through the process to never book your sweet heart's flight to America until you have the visa in your hand. I have seen too many instances where they go to get the visa and get a blue slip instead.

i totally agree with this. it has been reported many times on this site that visa issuance can take up to 12 days, so everyone should plan accordingly.

  4. If he is under 18, they should file for AOS now. If they didn't file an I-130 with his mother's, they need to file one now, along with the I-485. He will adjust status based on the pending I-130.

If he was over 18 at the time you married, his mother must file the I-130, There is currently about an 8 year wait for an over 18 child of an LPR.

thanks randy. her son is only 16 so age out is not an issue. i just thought i read somewhere that he couldn't adjust status since his mother has already received her green card.

  5. i am trying to help my wife's friend with aos paperwork. she entered the usa last year with a k3 visa and received her 2 year green card 3 months ago. her son came to the usa 2 months ago with the k4 visa. i seem to remember reading somewhere that the k4 cant adjust status because the mother has a green card and is no longer in k3 status. can someone please elaborate on this? what are their options?

  6. Hi guys, We have a disagreement over whether the passport style photos are are suppose to be attached to the DS-156 or not. I could swear, I remember reading that the people taking the documents attaches them, but I can't find it. Qingyun is showing me a letter dated 2003 that says you should attach the photos by stapling, glueing or taping. Help us out here! Thanks! Jeff

in our case, they did this at the medical exam. but, things have changed and the paperwork is turned in at the consulate instead of the medical nowadays. if you look at the ds-156 it says to attach photo here. i dont think it really matters too much.

  7. good news everyone. my lao po received her 2 yr. gc in the mail today. yee hawwww! she has been on the phone all day calling her friends, hehe. it took 6 months and 3 days, but we lost a month due to an rfe for the medical exam that uscis couldnt locate. happy days for 1 yr. and 9 months until time for lifting of conditions. btw, our online case status still shows pending, so it seems to be hit or miss with the online status.

  8. How much money are you allow to take into China? I am going to be there for a month and have to purchase tickets to Guangzhou also. So I am trying to find out what the limit is before I go.

10k usd or more and you have to report it to customs.

  9. Hi Guys,

I have good and bad news. My wife got her 2 year green card today, no interview, but her son got a request for more information.

Before they left China, both of them had their medical exams, but they did not get their vaccinations. I took them to a Civil Surgeon here and got their vaccinations done. The Civil Surgeon filled out all the necessary sections of the I-693, sealed them, and then I sent in all their forms in three books each, AOS, EAD, and AP. All of my wife's stuff went through with no problem, but her son's did not. They are saying we did not complete all of the sections of I-693 properly, and not all of the necessary screenings were done. Not true, they had all except the immunizations done in China, and I have a little red book for each of them that had all the exam results in them. I am thinking they either lost his medical stuff from Guangzhou, or they did not realize it was there, since they saw an incomplete I-693.

So, now, what is the best way to overcome this? Do we go to a Civil Surgeon and have him do everything all over again? Do we go to the Civil Surgeon and see if he can transfer all the information from the little red book to the I-693 form?

I don't think I want to argue with USCIS about it. I just want to do what I must to quickly take care of the problem.

What do you think? :Dah: ;)

The I-693 you sent in WAS incomplete, since it only had the vaccination section filled out. Yes, that's usually the way it's done. BUT, like you point out, "they lost his medical stuff from Guangzhou"

They screw up, you pay. That's usually the way it's done. You did nothing wrong.

randy is correct, as the same thing happened to us. after several phone calls and faxes to uscis, i discovered that the medical exam and i-129f were lost. so we had to redo the medical. grrrrr!

  10. We are doing a K2 follow to join for my wifes son and when she went for the interview they gave him a blue slip and requested DNA. This has delayed him getting here but if that is what we need to do then we will get it done. It took about two months just to get him into the consulate to have the swab done, then back to us for the testing, and back to the consulate with results.

The consulate received the DNA results on 4/14/09.

My question is how long will it take before they will send out an approval notice for the visa?

Anyone with any experience with this would be a big help to hear from you.

    Thanks,

steve and rong went thru the dna testing and the best i can remember you should expect to hear something in the next few weeks.

  11. My wife's two year green card expires on 8/17 of this year. We were planning on mailing the I-751 on 5/17 or soon thereafter, but now she is planning on going to China for one month starting on 5/29, as I have a month-long university trip to South Africa during this time. My question is, should we file on 5/17 and risk missing the biometrics appt. or should we wait until we are both back in the country and file on July 1?

Thanks for any input that you can offer.

i would wait until you are both back in the country. if you miss the biometrics appt., the uscis may consider your application abandoned.

  12. Well, just yesterday I got a RFE for a medical and vaccinations report for our AOS. We only did the vaccinations . We showed the doctor where it said that we only needed that done. Unfortunately the person at USCIS does not seem to know about it.

We will go back monday and get both done this time. We have only until May 6th to comply or risk getting our AOS denied, then we will have to start all over again.

the same thing happened to us. we called uscis and discovered that our original medical exam and I-129F packet was not merged with the AOS papers and they dont know where it is. it seems that we have to pay for their screw ups.

  13. my fiancee has been divorced since her daughter was 2 years old and have lived in another city from her father all her life.

my question does she need a letter for permision to leave China from him. he has never had custody of the daughter.

daughter is now 18 years old.

i just went thru the k1 and k2 and my stepdaughter is 18 and the father had custody on the divorce papers. once the child reaches 18 custody doesnt matter and you dont need a letter from the father. its even on the guz website somewhere. good luck!

  14. finally, we get the visa yesterday. it arrived at the post office on thursday april 9th and we received it from our liaison on the 11th. happy days again! it seems that every time guz has a holiday it delays visa receipt for a week or so.

  15. update. well, its been 8 days since my stepdaughter received pink and still no visa at the post office. since she and her mother had to return home today, they had to pay a service to pick up and mail the passport when it finally arrives. what a pain!!!!!!

  16. They should have gotten it out by Friday night, and the Post Office is not usually closed for 3 straight days, maybe Sunday or Monday, Tuesday at the latest. Good Luck, Mike & Yizhen

i agree mike. it appears that the visa was issued on friday, but not mailed. we have been checking the ems number and the post office daily. grrrrr!

  17. There are times GUZ works on the weekend. You should have the tracking number on the EMS form that was completed before leaving the consulate.

If it is going to the China Post near the consulate, have them just go over and try to collect it. They are even open on Sunday.

yes, we tried this already. guz is closed april 4th, 5th, and 6th for tomb sweeping holiday.

  18. unbelievable! my stepdaughter received pink on march 31st and the visa is still not at the post office. i called dos on april 3rd and they told me the visa was issued, so obviously guz didnt mail the visa yet as the tracking number is not showing up. since monday is a guz holiday the earliest it can be mailed out is tuesday and picked up on wednesday. my mother in law and stepdaughter are stuck in guz. grrrrr!
