I do not have 2008 because i am requesting a foriegn earned income tax exclusion(was in the Middle East). If I do need the 2008 return what would be the fastest way to obtain it? Link to comment

Order a tax transcript from the IRS for the last 3 years. It's easier and more complete. With a transcript you don't need the 1040s or W2s. If you didn't submit it, because you had no taxable income, it's never too late to do so. If that is the case, I recommend that you draw up an accounting statement showing your true income Link to comment

I always tell people to file even if it is a ZERO return, the consulate will want you to site the IRS rule and reason for not filing a return. Also filing is one thing that shows that you may have NOT given up US Domicile. US Domicile is REQUIRED in-order to sponsor an immigrant, no proof of US Domicile by the petitioner, then NO Visa.
