Finally K-1 visa in hand!

After an agonizing 12 months wait, my fiancee finally have her K-1 in hand. This board has been tremendously valuable for us during this period both in terms of information sharing and support. Thank you all.

 

In preparation for her moving to the US as well as the next step (AOS) for getting the green card, I've few misc. questions

 

1) Just like any visitors entering the country, one will have to declare what you bring in at the POE, which in our case would be the JFK in NY. Is there a dollar limit on what she can bring in and declare before having to pay any custom duty?

 

2) What documents will be required on her part in order for us to open a joint account? It's getting lot more restrictions nowadays since the 911

 

3) What would be the best way for her to officially adopt an English first name. Again, because of the 911 it's getting difficult to make name changes, even more so for a foreign national born overseas I suppose

Pete, Congrats! #1 Two cartons of cigarettes and two bottles of booze without duties is all I know. #2 After marriage take license, photo ID and SSN to personal banker, shouldn't be a problem to add her. #3 Haven't the faintest idea, Li kept hers.

I think it's a catch-22 situation. She won't be given the SSN until she has passed the AOS process, and what the VO will look at for proof of a genuine marriage during the AOS interview is a joint account!

Not true - K-1's are eligible for SS between approximately 10 and 75 days of arrival.

 

K-3's need to apply for (and get) EAD (with or without the AOS application) to be eligible for an SSH

Do you mean 10-75 days after you hand in your AOS application? But 10 days!!! I would have never thought the gov't could be so efficient!

AOS and SS are not related. You need employment authorization (or the green card) to get an SSN. K-1's are work authorized for 90 days after arrival. During this time they may apply for SS. However, since the USCIS and SS are on different computer systems, there is a little slack at either end.

 

The EAD card is also good for applying for SS

So in other words you'll only need the EAD in order to get the SSN correct? I think on average it may take 60-90 days to apply for the EAD. Can you apply for the EAD even before the marriage?

nope, k-1 is a work authorized visa, you can get a ss# soon after entry.

 

As for booze & cigs the duty free shop shop can tell you that, money is < $10k

 

cant help you with the name ,jin's keeping hers, but there is loads of threads on this on the AOS forum.

Your SO is K-1. She may apply for SS between around 10 days after arrival in the US, and before the 76th day after her arrival in the US.

 

OR . . . AFTER she gets her EAD or green card

 

The SS card arrives within 10 days to 2 weeks.

 

The JFK stamp may look pretty in the passport (to some employers), but does not affect anything immigration-wise.

 

She is work authorized for 90 days (going through ANY Point of Entry), and once she has her EAD card, or her green card.

That is not completely correct. She can get a ssn after 2 weeks and before her I-94 gets old or expires. I think you need some many days left on it. If you wait till after marriage you can get ssn in new name. Than file AOS and EAD after you get EAD (much faster than AOS) you can get state ID in new name with SSN number in new name.

Hmmm ... I'm a simple guy, OP needs a simple answer:

 

1. IDK

 

2. To open a joint account she needs a social security number, personal appearance, and two forms of photo ID. You can get the SS number when her entry to the US is reported in a database that the SS folks access. This takes about 10 days.

 

Get married in the first week. Bring evidence of marriage to the SS office at about day ten. Print out the various directives that say she's entitled to a SS card (I'm to lazy to search but this has been covered many many times). Get the SS number in her married name. SS offices are notoriously stupid, which is why you need to print their own regulations and hand them to them. If you escalate to the supervisor and it doesn't work just try another office. I actually called the SS complaint line after being turned down and asked them to instruct our local SS office manager on the rules. When we went in the next day we were treated like royalty.

 

3. Name change ... just file the 485 in the desired name. Once a Green Card is issued in that name everything else will fall in to place. You can, in parallel, do a common law name change if your state accepts it; the feds do. It's usually not necessary.
