david_dawei Posted May 12, 2006 Report Share Posted May 12, 2006 (edited) I have questions about the consular namecheck processing for K3 and CR1 (for the same beneficiary): 1) When the K3 and CR1 cases arrive at the consulate (for the same beneficiary), are both required to have a namecheck regardless of circumstances? If YES, then it sounds like both are mandatory. If NO: 2) If the two cases arrive at the consulate close to each other and a namecheck starts on both, and if one is only truly necessary, is it adviseable to contact the consulate to let them know this has occurred? 3) Are there circumstances where both namechecks are needed and times when they are not ? (don't expect examples, only want to know if this variation occurs and if this is a frequent occurrence or not-- ie: The CR1 is mandatory but not the K3). USCONGUZ Posted May 13, 2006 Report Share Posted May 13, 2006 (edited) 1) No. If we have already received the namecheck results in a K3 case, we normally apply those results to the CR/IR case. 2) You do not need to contact the Consulate in this situation. We will use the first namecheck result that we receive. 3) Namecheck results can expire. In some cases, we need to resend namechecks when the previous results are too old. If the "old" namecheck results are from the K3 case, and we've already received the CR/IR case file, then the new namecheck would be sent from the CR/IR case. In most K1 and K3 cases, the namecheck process has already been started at NVC. It is impossible to predict how long the namecheck process will take. Each case is different. If "the name check process has already been started at NVC" means NVC just initiate the process, would you hold the sending of Packet 3 forms or scheduling interview process to wait for the results? USCONGUZ Posted May 16, 2006 Report Share Posted May 16, 2006 (edited) In most cases the namecheck process for K petitions is completed at the NVC before they send the file to post. I'm sure there are a small number of cases that arrive at post with namechecks still pending, but it is not common.
