California law does not allow someone to get a drivers license if their "legal presence" expires less than 60 days from the date they apply for their license. I don't know how the California DMV will treat someone who's AOS is pending, but not approved. Thanks for the info. I'm sure every state has different rules. Link to comment
tywy_99 Posted October 8, 2005 Report Share Posted October 8, 2005 I posted something about a week or two ago about California DMV but I can't find it.I went to their site and one of the things they can use for legal presence is the I-797C receipt notice of the I-485. This notice is proof of pending status for a LPR.That is what I took to Virginia DMV and they accepted it.So far the questions on DLs from different states, I found out basically the same thing. The I-797C as proof of legal presence. I've looked at VA, PA, FL, TX, and CA. they all mention it so try that at the DMV. Go prepared with literature about it from their website. Like any other agency, they have people who don't know everything and try to tell you no.Go to CA. DMV website and searh for info on 'Legal Presence.' -good luck Link to comment
