K-3 interview January 24

Thanks everyone for the responses to this thread. It is very helpful for me too since I am not totally clear as to which way to go. I will print this as well. So far I have not made any mistakes in filing because I found cfl before filing. All the advise and info has been invaluable, no need for layer. You guys/girls should send me a bill   :(

Just weigh out your options and see which way is best suited for you and your wife. Everyone that is involved with the K-3/CR-1 process are faced with different circumstances in which descisions must be made.

There was a time when the I-130 approval took forever and the K-3 process moved along. In those cases, most people would file AOS upon I-130 approval. Their family was together in the states building on the relationship, establishing ties and such to use at the eventual AOS interview.

Either way, CR-1 or AOS takes time but both have their advantages.

The good thing about the K-3 and AOS is that you are all together which makes the waiting more bearable. However, with the CR-1, your wife enters the US with a 2-year green card, along with the benefits, and the 2-year conditional status begins but unless you two are together in China, or the spouse is here on the K-3, there will be more time to wait and to be apart.

I'm curious to see the time involved with those who have gone the IV route. I think 'resp' went that route and it wasn't too aweful long, the best I remember.

USC's and LPR's who have petitioned for family members that fall into the 1st, 2nd, 3rd, and 4th preference catagories have been waiting literally for years for family members but spouses of USC's do not fall into this catagory and don't have to wait for a visa number. That being the case, hopefully things will move at a good pace for them.

At this point I'm not sure which is faster for us but the I 130 was approved last week. So I assume there will be no need for the k-3 visa.

OK, what Dean said here is right, it is my choice that she go back. She is visiting her family again, and the interview will be part of it.

 

 

Please do not ready do much into it.
