I-864 and other docs needed for K2 (a minor)?

Recommended Posts

Quick question...

Filling AOS (I-485) for K1 and K2...

Submitting a host of supporting documents (I-864, tax returns, etc.) for K1...

Do I need to include a complete (duplicate) set of the documents which already included with a K1

Plan to just submit 2 I-485's (one for K1 and one for K2) and just one set of supporting documents. Is it ok?

of course separate I-94's, visa's, and passport...

Thx

Did that. No mention of docs needed for K2 if subbmit at the same time with K1.

I-864 instructions (1st page, General filling Instructions, 2nd paragraph):

"You must submit an affidavit of support for each applicant for

immigrant status. You may submit photocopies of this affidavit

for any spouse or children immigrating with an immigrant you

are sponsoring. For purposes of this form, a spouse or child is

immigrating with an immigrant you are sponsoring if he or she

is: 1) listed in Part 3 of this affidavit of support; and 2)

applies for an immigrant visa or adjustment of status within 6

months of the date this affidavit of support is originally

completed and signed...."

This makes no sense if I attach a photocopy of I-864 (for K2) in the same package along with the original I-864 (for K1) along with the rest of docs.

Unless AOS for K2 is filled separately, but within 6 month as stated, then photocopy of I-864 is attached.

If you had filed OAS for K2 in the past, what did you do?

Thx

This is what I did. I sent in a full set of documents for Jingwen (K-1). For each pf the children (K-2): I sent in:

1. Form FC-029, signed by the child (both are over 18) stating that all of his or her copies are exact copies.

2. The I-485, signed, with ADIT photos attached.

3. The G-325A (in quadruplicate), signed by the child.

4. Copy of the I-797, Notice of Approval for the original I-129F for the mother.

5. Copy of the passport's main page, copy of the K-2 visa, and a copy of the I-94.

6. Copy of the notarial birth certificate (Chinese and certified English translation).

7. Copy of the mother's marriage certificate.

8. Sealed envelope from the Civil Surgeon.

9. A second FC-029, signed by me, stating that my copies are exact copies.

10. Copy of the signed and notarized I-864.

11. Employment verification and copies of payroll statements for the prior three months.

12. Copies of federal income tax returns for the prior three years.
