How long can Chinese tourist visa holder stay in the US now??

Recommended Posts

Hello! I have not been here for a while, hope everyone is doing well!

My parents are visiting the US on a 10 year tourist visa, how long can they stay in the state for a maximum length of time? I know in the past it was 6 months, however I heard Trump changed the policy, not sure since when?... Thanks.

Hi - welcome back! Enjoy your parents' visit! And come by more often.

The length of stay is decided at the POE by the Immigrations Officer, up to a maximum of six months. It should state this (the 6 months) on the visa.

Your parents should be prepared to discuss their plans for the trip.

To be safe I'd check their most recent I94: https://i94.cbp.dhs.gov/

There should be an Admit Until Date listed. This should be the same date that was stamped in their passports when they entered.

I highly suggest not staying until the absolute last date. There have been people who got their visas cancelled because a flight delay caused them to overstay their visa by one day.

The I-94 site won't have an entry for her parents until AFTER they are processed at the POE.

It's unclear from her post if they are in the U.S., or still in China, but I assumed the latter.

I assumed "are visiting" means they're here already, but I guess now she has both cases covered :gleam:
