dnoblett Posted August 11, 2015 Report Share Posted August 11, 2015 Firstly your spouse needs to naturalize and become a US Citizen, once a Citizen she can then file an I-130 petition for a married or unmarried daughter over age 21. As for the grandchild, once daughter is applying for visa at NVC based on the approved I-130 petition she can apply for a visa for her child (derivative visa). http://travel.state.gov/content/visas/english/immigrate/family/family-preference.html#7 This will take a few years Married children of US citizens get third preference for visas (Family Third Preference (F3)) http://travel.state.gov/content/visas/english/immigrate/family/family-preference.html#1 Bulletin shows F3 class petitions filed April 2004 just getting assigned visa numbers, so plan on a 10 year wait for this process. http://travel.state.gov/content/visas/english/law-and-policy/bulletin.html Link to comment
dnoblett Posted August 11, 2015 Report Share Posted August 11, 2015 Only other option I can think of is if she somehow found a proper American boyfriend, got divorced and then marries the American, he could petition for her and her child. One member managed to match his friend with his sister in law and helped them with the petition process. Much faster than if his wife had petitioned for her sibling. Link to comment
