Randy W
..... Hopefully, you can elaborate on the situation. Does this involve a child over the age of 18? Do you have any indication why it may have been returned? Link to comment
dnoblett
Tends to happen much more for K-1 than Spouse visas. Wait and find out what USCIS decides to do with it, they should send you something in the mail. Unless you have a potential step child between 18 and 21 that would have qualified for a K2 visa, many simply go to China and marry, then start over filing an I-130 for a spouse visa. Only caveats:If there is a potential step child 18 to 21, step parent cannot file a petition, their biological parent has to once in the states and has a green card. What the consulate and USCIS marks the denied K-1, if for some reason they indicate some sort of misrepresentation on the denial, this can affect future petitions and has to be dealt with. USCIS does a couple different things with returned K-1 petitions:They expire the petition, if they do this you can either try another K-1 petition, or visit your Fiancee and get married, and then file for a spouse visa.OR; They revoke the K-1, in this case the revocation can affect future petitions.More: http://candleforlove.com/forums/topic/38457-after-cr1-received-i-129f-expiration-from-previous-k1/ Study topics tagged NOID http://candleforlove.com/forums/tags/forums/NOID/ Link to comment
HotBaozi
We plan to take them to the mat in Federal court as a derivative aged-out as a result of the case being sent back to the USCIS. It took more than one-year for them to respond to any and all inquiries, then they send this piece of shit letter. http://i57.tinypic.com/j6ipty.png Link to comment
Randy W
A recent VERY similar case - word is that they ARE tending to return petitions with a potential K-2 "close" to the age of 21 Read this over carefully, if you haven't already No One Can be Held Accountable! Link to comment
