A little confusion over the OMB date on the I-864

Hey all,

 

My honey and I are preparing for the interview and are waiting until the new I-864 edition comes out. According to http://www.uscis.gov/i-864, the current edition expires at the end of this month and it seems that versions previous to the current edition are not accepted. I just thought I'd make everybody at the same stage in the game as I aware of this.

This topic comes up every so often over the years. OMB expiration date is NOT the form's expiration, this is an internal review date set by the Office of Management and Budget, having to do with a review and comment period.

Always refer to the edition date at the bottom of the form and what USCIS indicates as the current edition NOT the OMB date...

DO NOT WAIT - always simply use the most recent available edition. The form is unlikely to be re-issued simply to change the expiration date, and would be unlikely to change in any other way. Any NEW form will likely say "prior editions accepted"

 

"Expiration date" shown on forms

Note that any "expiration date" listed on a form is NOT that form's expiration date, but the Office of Management and Budget approval expiration date as required by the Paperwork Reduction act. Data is collected and submitted to the OMB in order to track its usage. A form may contain a notation such as:

Approved OMB 1405-0134
Expires 11/30/2011
Estimated Burden 1 Hour*

but the form may be used beyond 11/30/2011 unless the new instructions specifically state otherwise. Of course, it's best to try to locate the most recent version of any form you submit

Only if indicated on USCIS website, I highly doubt a new edition will be released at the end of the month.

You may be waiting for a LONG time, if you're expecting that to happen.

 

there is no reason to wait. Your I-864 WILL be accepted. There really is NO CONFUSION on this issue (except, of course, for the confusing notation on the form).

 

Don't expect ANYTHING to happen on or before (or even AFTER) March 31

I found this notice hat was posted after the last change to the I-864 in March of 2013. Notice that there was a three month period where the old form was still accepted, AFTER the new form was released.

 

New Affidavit of Support form unveiled by USCIS (Form I-864). Older versions of Form I-864 will no longer be accepted after 23 June 2013

 

You can expect a similar grace period for use of the old form, IF the NEW form is substantially changed from the old form.

 

At this point, we have no reason to even expect a new form, with or without any changes at all. DON'T WAIT.
