Questions about I-130 IR-1/IR-2

Just getting the final things together for bobs and jens CR1/ IR1 papers.

 

I have a 3 questions

 

1) I-130 section C line 17.

(List spouse and all children of your relative)

 

Do i put bobs wife and son here?

(There reason i ask is when i filled this out for hong i put none and had no problems.)

 

2) same section and same line for stepson.

What should be entered here for stepsons I-130

 

3) section D line1

I would enter stepsons name here right?

1) C-17 has to do with immigrant, it will be immigrant's children.

 

2) C-17 On step-son's petition, you will list immigrating spouse, "Mother"

 

3) Yes, on mother's petition list step child, and on step child's petition list mother.

I just thought of another question.

 

Stepson has different family name than mother.

Stepson has fathers family name.

 

Could this cause problems?

Nope, it is known that mother does not take family name of spouse in China, so children would have father's name. Simply attach copy of birth cert to show relationship to mother.

It didn't cause any problem with my son, Mike. His last name was not the same as his mother's.

I have all documents for both mother and stepson.

 

Marriage cert, divorce cert, birth cert, and even custody papers for stepson.

Father sign custody papers giving mother FULL custody of son.

 

At first father did not want son to leave china but latter gave in.

 

BTW: everything/all documents have been translated and all originals are in my possession.

All originals will stay with me until interview day.

 

Hong and i (and of course Bob) will be there for interview day.

Is Jen the U.S. citizen petitioning for spouse Bob, the immigrant? If so, then in C-17 you would fill in Bob's current spouse (Jen) and Bob's current children. If it's the other way around (Bob the U.S. citizen petitioning for spouse Jen, the immigrant), then you would fill in Jen's current spouse (Bob) and Jen's current children.

 

 

2) same section and same line for stepson.

What should be entered here for stepsons I-130

It would be the stepson's current spouse and current children (likely he has none of these).

 

 

3) section D line1

I would enter stepsons name here right?

Note: Bob is US citizen petitioner and Jen is Chinese benificiary.

 

Correct Bob = US citizen.

Jen (Zhengqin) = Chinese citizen.

 

Now I'm confused, between Dans post and newacct the advise is not clear.

what post is correct?

 

I beleave Dan is correct and more stright forward.

But still confused.

 

Back when i did hongs (my wife) I-130 i put NONE.

Seeing she had no children.

Newacct is correct on the #2 answer... Stepson's petition has to do with him and his "family" which he does not have, so C,17 is none on step son's petition.

C17 (Relationship) would be STEPSON right?

 

C21 would i say NONE or give address for stepson.

C-17 on mother's petition should be son, the child is not her step-son, view all questions in section C from the perspective of the person named in question C-1

 

C-21 depends on whether or not actually lived together, on Spouse petition if they lived a period of time together, like if US Citizen lived in China for work, then an address would be listed on Spouse petition, other wise "NONE", as for step son's petition, the answer would be N/A since the question indicates "Filing for Spouse"
