adding newborn to visa petition (with NVC)

My wife and I have petitioned for my wife's daughter (over 21, unmarried). The case has gone to the NVC and we've paid all of the fees for both the I-864 and DS-230. We are just waiting now as there has been a back log of apps apparently.

 

I want to make sure what the policy and procedure is for adding a newborn to the visa app. Can we do this? She remains unmarried of course. But then I guess we just need to send in the birth certificate and passport?

If you're a US Citizen and this newborn is your child. The newborn is a US Citizen regardless of where the birth takes place. You need to register the birth abroad with the US Consulate.

Sorry for the confusion. The newborn is the daughter's child. She did not get married.

Let me get the details clear, sounds like your spouse filed an I-130 petition for her daughter some time ago (F2B Preference) and in the mean time she had a child out of wedlock.

From DOS website it sounds like you will need to provide an additional I-864, and when requested for DS-230 provide an additional DS-230 for the child and pay additional visa fee for child, and submit additional documents for child.

Can My Family Members also Receive Immigrant Visas?

 

Based on your approved petition, your spouse and minor unmarried children, younger than 21, may apply for immigrant visas with you. Like you, they must also fill out required application forms, obtain required civil documents, pay the required fees, and undergo medical examinations.
